AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A
CONTRACT WITH AUTOMATED LOGIC- UNITED ENVIRONMENTAL SERVICES
FOR THE PURCHASE AND INSTALLATION OF A CHILLER FOR THE CITY HALL
COMPLEX AND A COMPRESSOR FOR THE BAYTOWN COMMUNITY CENTER:
AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN. IN AN AMOUNT NOT TO
EXCEED THREE HUNDRED FIFTY -SIX THOUSAND FOUR HUNDRED THIRTY -
NINE AND NO /100 DOLLARS ($356,439.00): AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.
WHEREAS, the life expectancv ofthe existing chiller unit at City Hall is approximately 20 years; and
\N'I IEREAS. such chiller unit, awhile only I I years old, has and continues to have repeated critical
failures: and
WHEREAS. similarly, the compressor and the pump for the Community Center chiller unit has also
experienced repeated failures; and
NVHEREAS, in order to replace these units, the City will have to comply with the new requirements Of
the International Building Code as adopted by the City: and
%\'HEREAS, upon completion of this installation of the chiller unit at City I -fall and the compressor at
the Community Center, the City will have a system which incorporates redundancies, improves efficiencies.
and decreases annual utility costs; and
WHEREAS. the above- referenced expenditures are necessary due to unforeseen damage to the City_
I Jail chiller and the Community Center compressor; NONNI THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN. TEXAS:
Section 1: That all matters and facts set Forth in the recitals hereinabove are found to be true and
such recitals are hereby approved and made a part of this Ordinance for all purposes and are adopted as a part
Of the judgment and findings by the City Council of the City of Baytown, Texas.
Section 2: That the City Council of the City of Baytown. Texas. hereby authorizes the City
Manager to negotiate and execute a contract with Automated Loaic - United Environmental Services for the
purchase and installation of a chiller for the City Hall complex and a compressor for the Baytown CO11111111n1ty
Center.: under terms and conditions deemed satisfactory to the City Attorney and the City Manager.
Section 3: That the City Council of the City of Baytown authorizes payment to Automated Logic
- United Environmental Services in an amount not to exceed THREE HUNDRED FIFTY -SIX THOUSAND
FOUR HUNDRED THIRTY -NINE AND NO /100 DOLLARS (5356.439.00), pursuant to the agreement
authorized in Section 2 hereof.
Section 4: That the City Manager is hereby granted general authority to approve any change
order involving a decrease or an increase in costs of TWENTY -FIVE THOUSAND AND NO/] 00 DOLLARS
(525,000.00) or less; however, the original contract price may not be increased by more than twenty -five
percent (25 %) or decreased by more than twenty -five percent (25 %) without the consent of the contractor to
such decrease.
Section 5: This ordinance shall take effect immediately from and after its passage by the City
Council ofthe City of Baytoxn.
