TI- TROUGH THE HOUSTON- GALVESTON AREA COUNCIL FOR THE PURCI LASE OF ONE (1) 2009 NEW HOLLAND T5050 2WD CAB TRACTOR AND ONE (1) ALAMO RIGHT HAND INTERSTATER WITI1 88" FLAIL HEAD MOWER FOR THE PARKS AND RECREATION DEPARTMENT: MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR TI IE EFFECTIVE DATE THEREOF. WHEREAS. the Cite Council of the City of Baytown has approved an Interlocal Agreement which authorizes the I louston- Galveston Area Council to take bids for certain items on behalfofthe City of Baytown; and WHEREAS. pursuant to such agreement, the Houston - Galveston Area Council has taken bids for one (1) 2009 New Holland T5050 2hvd cab tractor and (1) Alanio Right Iland Interstater with 88" flail head mower; NOW THEREFORE BE IT ORDAINED I3Y THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City COUnCil Of the City of Baytown hereby authorizes the payment of SIXTY -THREE THOUSAND FIVE HUNDRED AND NO /100 DOLLARS ($63.500.00) to Lansdowne - Moody Company, L.P., through the I- louston - Galveston Area Council Im- the purchase of one (1) 2009 New Holland T5050 2wd cab tractor and one (1) Alamo Right Hand Interstater with 88" flail head plower for the Parks and Recreation Department. Section 2: That pursuant to the provisions of Texas Local Government Code Annotated §252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of TWENTY -FIVE THOUSAND AND NO /100 DOLLARS ($25.000.00) or less. provided that the original contract price may not be increased by more than twenty -five percent (25 %) or decreased by more than twenty-five percent (25 %) without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. A INTRODUCED.
