Ordinance No. 11,207 ORDINANCE NO. 11,207 AN ORDINANCE OF THE CITY COUNCIL OF TI-IE CITY OF BAYTOWN. TEXAS. RENEWING "1'IIE AGREEMENT WITI-1 AS&G CLAIMS ADMINISTRATION. INC.. AS THE THIRD PARTY ADMINISTRATOR FOR THE ADMINISTRATION OF TIlE CITY'S WORKERS' COMPENSATION PROGRAM: AUTHORIZING PAYMENT IN AN AMOUNT NOT TO EXCEED TWENTY-FIVE THOUSAND AND NO/I00 DOLLARS ($25,000.00) FOR THE SERVICES ASSOCIATED WITH THE CITY'S WORKERS' COMPENSATION PROGRAM; AUTHORIZING THE ACQUISITION FROM MIDWEST EMPLOYERS CASUALTY COMPANY OF THE CITY'S EXCESS WORKERS' COMPENSATION INSURANCE; AUTHORIZING PAYMENT IN THE AMOUNT OF FORTY-FOUR THOUSAND NINE HUNDRED FORTY-ONE AND NO/100 DOLLARS ($44.941.00) FOR TI-IE EXCESS WORKERS' COMPENSATION INSURANCE PROGRAM; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ****************************************************************************** BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby renews its agreement with AS&G Claims Administration. Inc.. as the third party administrator for the administration of the City's Workers' Compensation Program on behalf of the City of Baytown. Section 2: That the City Council of the City of Baytown authorizes payment to AS&G Claims Administration, Inc.. in an amount not to exceed TWENTY-FIVE THOUSAND AND NO/100 DOLLARS ($25,000.00). pursuant to the agreement authorized in Section 1 hereof. Section 3: That for the third party administrator services. the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of TWENTY-FIVE THOUSAND AND NO/100 DOLLARS ($25.000.00) or less: however. the original contract price may not be increased by more than twenty-live percent (25%) or decreased by more than twenty-five percent (25%) without the consent of the contractor to such decrease. Section 4: That the City Council of the City of Baytown. Texas, hereby authorizes the City Manager to acquire from Midwest Employers Casualty Company the City's Excess Workers' Compensation Insurance. Section 5: That the City Council of the City of Baytown authorizes payment to Midwest Employers Casualty Company in an amount of FORTY-FOUR THOUSAND NINE HUNDRED FORTY-ONE AND NO/100 DOLLARS ($44.941.00) for the services associated with the Excess Workers' Compensation Insurance Program, pursuant to the purchase authorized in Section 4 hereof. Section 6: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. INTRODUCED.
