REPUBLIC AND 1420 HAWTHORNE TO SOUTHWEST INNOVATIONS, INC., FOR THE SUM OF NINETY -SIX THOUSAND TWO HUNDRED FIFTY -FIVE AND NO /100 DOLLARS ($96,255.00); AUTHORIZING PAYMENT THEREOF; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WIIFREAS, the City of Baytown's Community Development Program did advertise for bids for the housing reconstruction projects located at 319 W. Republic and 1420 Hawthorne to be received July 31, 2009: and WI IEREAS, notice to all bidders as to the time and place. when and where the contract would be let was published pursuant to provisions of Section 74 of the Charter of the City of Baytown: and WI IEREAS, all bids were opened and publicly read at City Hall at 10:00 a.m., Friday. July 31, 2009, as per published notice to bidders; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN. TEXAS: Section I: That the City Council of the City of Baytown hereby accepts the bid of Southwest Innovations, Inc.. for the sum of NINETY -SIX THOUSAND TWO IIUNDRED FIFTY -FIVE AND NO /100 DOLLARS ($96,255.00) for the following housing reconstruction projects and authorizes payment thereof upon final completion and acceptance of the work by the owner and the Baytown Community Development Program: 319 W. Republic 1950 1 1 434_ _ 1.035 541823 00 548.127.50 1420 11 awthorne 1945 1.086 _ 1.03_5 $35.320.00 $48.127.50 Total 596,255.00 —. - Section 2: That pursuant to the provisions of Texas Local Government Code Annotated §252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of TWENTY -FIVE THOUSAND AND NO /100 DOLLARS ($25,000.00) or less. subject to the provision that the original contract price may not be increased by more than twenty-five percent (25 %) or decreased by more than twenty-five percent (25 %) without the consent of the contractor to such decrease.
