AN ORDINANCE OF THE CITY COUNCIL OF "I-HE CITY OF BAYTOWN,
TEXAS, ADDING A 56.8632 ACRE TRACT LOCATED SOUTH OF
WALTER L_ JENKINS PARK AND WEST OF J.C. HOLLAWAY PARK IN
THE CHRISTIAN SMITH SURVEY, ABSTRACT 69, HARRIS COUNTY,
TEXAS, TO COUNCIL DISTRICT NO. 5; REPEALING ORDINANCES
INCONSISTENT HEREWITH: CONTAINING A SAVINGS CLAUSE; AND
PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF-

WHEREAS, Section 17(1) of the Charter of the City of Baytown provides that the City
Council shall redistrict the City if the growth of the City justifies; and
WHEREAS, it is necessary to include the newly annexed territory described herein in a
Council District: NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: Council District No_ 5 is hereby redistricted by the addition of that
property which is described in Exhibit "A," which is attached hereto and incorporated herein for
all intents and purposes.
Section 2: All ordinances or parts of ordinances inconsistent with the terms of this
ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of
such inconsistency and in all other respects this ordinance shall be cumulative of other
ordinances regulating and governing the subject matter covered by this ordinance.
Section 3: If any provisions, section, exception, subsection, paragraph. sentence,
clause or phrase of this ordinance or the application of same to any person or set of
circumstances, shall for any reason be held unconstitutional_ void or invalid, such invalidity shall
not affect the validity of the remaining provisions of this ordinance or their application to other
persons or sets of circumstances and to this end all provisions of this ordinance are declared to be
severable.
Section 4: This ordinance shall take effect from and after ten (1 0) days from its
passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing
the caption of this ordinance to be published in the official newspaper of the City of Baytown at
least twice within ten (10) days after passage ofthis ordinance.

THE CHRISTIAN SM1TH SURVEY, A -69
LOCATED IN HARRIS COUNTY, TEXAS
Being a tract of land containing 56.8632 -acres (2,476,959 square feet) being all of
a described as a 54 -acre tract situated in the Christian Smith Survey, A -69 in Harris
County, Texas as described by Volume 228, Page 315 of Harris County, Texas. Said
56.8632 -acre tract being more particularly described by metes and bounds as follows:
BEGINNING at a 5/8 -inch iron rod set at a point of intersection of the Southeast
right -of -way line of au existing rail road line based on a 100 foot width and the east right -
of -way line of Crosby Cedar Bayou Road and for the southwest corner of a comer of the
Jenkins Park entrance and right -of -way, for the most Southwesterly Northwest corner of
said tract herein described;
THENCE North 751 49' 44" East, a distance of 200.69 feet to a 5/8 -inch iron rod
set for a corner of the herein described tract of land;
THENCE North 280 05' 13" East, a distance of 185.26 feet to a 5/8 -inch iron rod
found for the Northeasternmost Northwest corner of the herein described tract of land;
THENCE North 81° 12' 10" East coincident with the south line of said Jenkins
Park, a distance of 2,182.34 feet to a 5/8 -inch iron rod set for the Northeast corner of the
herein described tract of land, and for a point 100.00 feet West of, the West line of
Packwood place Section 2 subdivision;
THENCE South 14° 39' 12" East coincident with the West line of a City of
Baytown owned tract of land (based on a 100 foot width) that connects said Jenkins Park
to Hollaway Park another City of Baytown owned property, a distance of 1,173.22 feet to
a 5/8 -inch iron rod set for the Southeast comer of the herein described tract of land, and
for a point in the North line of Lot 38, Block 1 of Bayou Oaks Estates Section 2, a
subdivision in Harris County, Texas;
THENCE South 80° 32' 28" West coincident with said North line of Bayou Oaks
Estates Section 2, a distance of 588.44 feet to a 5/8 -inch iron rod set for an interior
corner of the herein described tract of land and the Northwest comer of said Bayou Oaks
Estates Section 2;
