Ordinance No. 11,071ORDINANCE NO. 11,071 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, "TEXAS, RATIFYING CHANGE ORDER NO. 1 TO THE JAMES STREET WATER WELL REPAIR PROJECT AND THE EXPENDITURE OF THIRTY-EIGHT THOUSAND AND NO/100 DOLLARS ($38.000.00); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, on February 28. 2008, the City Council of the City of Baytown, via Ordinance No. 10,845, authorized a contract with Weisinger Water Well. Inc.. for the James Street Water Well Repair Project in the amount of TWO HUNDRED NINETEEN THOUSAND EIGHT HUNDRED AND NO/100 DOLLARS ($219.800.00): and WHEREAS, after the commencement of the work, it was determined that the obstruction originally seen from a camera survey was more extensive than originally thought -- namely there was a buckling of the casing and a hole in the mill slot screen section of the well, and WHEREAS, in order to repair the well. a change order was submitted in the amount of THIRTY-EIGHT THOUSAND AND NO/] 00 DOLLARS ($38,000.00): and WHEREAS, the City Council gave the City Manager the authority to approve change orders up to 25% of the contract amount, not to exceed TWENTY-FIVE THOUSAND AND NO/] 00 DOLLARS ($25,000.00); and WHEREAS, the dollar amount in Change Order No. 1 exceeded the City Manager's authority by THIRTEEN THOUSAND AND NO/ 100 DOLLARS ($13,000.00): and WHEREAS. in error, the change order was executed without the City Council's prior approval; the project was successfully completed; and Weisinger Water Well. Inc., was paid for its services: and WHEREAS, the City Council acknowledges the mistake and herein ratifies Change Order No. 1 to the James Street Water Well Repair Project; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown. Texas, hereby ratifies Change Order No. I to the James Street Water Well Repair Project and the expenditure of THIRTY-EIGHT THOUSAND AND NO/100 DOLLARS ($38.000.00). A copy of said change order is attached hereto. marked Exhibit "A" and made a part hereof for all intents and purposes. We then sent a copy of the Camera Survey to a company in California that specializes in swaging and patching of subsidence breaks and holes in water wells. We have been told that these areas of the well can be repaired. We are recommending that the break at a depth of 279' be swaged to the original inside diameter of the casing and chert patched. The hole at a depth of 389' should be patched to stop any sand intrusion in to the well caused by having an open hole in the screened area of the well. This will keep the well from having to be relined with a smaller screen and liner that will cut the water production of the water well. The costs for these services are as follows: Materials and labor to perform the swaging and patching $29,000.00 Rig time 20 hrs Q 5350.00 per hour $7000.00 Perform one Camera Survey to check the placement of the patches2� 0QO-O Total estimated costs 538,000.00 Thank you for the opportunity to offer you our services as we wait for your response.
