Ordinance No. 11,061ORDINANCE NO. 11,061 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING ORDINANCE NO. 11,016 PASSED ON THE 25"'-'DAY OF NOVEMBER, 2008, TO EXTEND THE TEMPORARY WAIVER OF FEES ADDRESSED THEREIN FOR STRUCTURES THAT WERE DAMAGED BY HURRICANE IKE FROM JANUARY 30, 2009, TO APRIL 1, 2009 AND TO PROVIDE A MANNER FOR FURTHER EXTENSIONS NOT TO EXTEND BEYOND JUNE 1. 2009: AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS. Hurricane Ike caused widespread. severe damage and loss of property within the City of Baytown due to its high winds and tidal surges and other public calamity resulting therefrom: and WHEREAS. in efforts to combat the severe economic and social disruption caused by Hurricane Ike, the City Council of the City of Baytown waived certain permit fees until January 30, 2009; and WHEREAS, the City Council finds that continuing the limited wavier of permit fees as specified in Ordinance 11,016 will accomplish a public purpose, including, but not limited to, ensuring that permits fees are not a deterrent for the proper repair of structures, encouraging more rapid recovery efforts thus enhancing economic development, and protecting the health, safety and welfare of the citizens of Baytown; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN. TEXAS: Section 1: That all matters and facts set forth in the recitals hereinabove are found to be true and such recitals are hereby approved and made a part of this Ordinance for all purposes and are adopted as a part of the judgment and findings by the City Council of the City of Baytown, Texas. Section 2: That the temporary waiver of fees addressed in Ordinance No. 11,016, passed by the City Council on the 25`h day of November. 2008, for structures that were damaged by Hurricane Ike is hereby extended from January 30, 2009, to April 1. 2009. Section 3: That the City Manager of the City of Baytown is hereby authorized to extend the temporary waiver of fees beyond the time period specified in Section 2 hereof for a period of time not to extend beyond June 1, 2009, should the City Manager determine in his sole discretion determine that such extension remains necessary to accomplish the public purpose specified in the recitals hereof. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown and shall expire at 5:00 p.m. on April 1, 2009, unless otherwise extended pursuant to Section 3 hereinabove.
