AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN. TEXAS, ACCEPTING
THE BID OF ALL AMERICAN DEMOLITION. LLC. FOR THE DEMOLITION OF BUILDING
NOS. 1 AND 5 AT 1800 N. ALEXANDER: AUTHORIZING PAYMENT BY THE CITY OF
BAYTOWN, IN THE AMOUNT OF ONE HUNDRED FIFTEEN THOUSAND AND NO /100
DOLLARS ($115,000.00): MAKING OTHER PROVISIONS RELATED TIIERETO: AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the City of Baytown advertised for bids for the demolition of Building Nos. 1 and 5 at 1800 N.
Alexander to be received on October 31. 2008: and
WHEREAS, notice to bidders as to the time and place, when and where the contract would be let was published
pursuant to the provisions of Chapter 252 of the Texas Local Government Code; and
WHEREAS. all bids were opened and publicly read in City Hall at 10:00 a.m., Friday, October 31, 2008. as per
published notice to bidders: NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That subject to the contingencies expressed in Section 2 hereof, the City Council of the City of
Baytown hereby accepts the bid of All American Demolition. LLC, for the demolition of Building Nos. 1 and 5 at 1800
N. Alexander for the sum of ONE HUNDRED FIFTEEN THOUSAND AND NO/] 00 DOLLARS ($115.000.00) and
authorizes payment thereof.
Section 2: That the acceptance of the bid and the payment authorized in Section 1 is expressly contingent
upon the failure of Baytown Retail, LLC:
1. to obtain a demolition permit on or before January 26. 2009, or
2. to demolish Building Nos. 1 and 5 on or before February 25, 2009.
Section 3: That pursuant to the provisions ofTexas Local Government Code Annotated §252.048, the City
Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of
TWENTY -FIVE THOUSAND AND NO /100 DOLLARS ($25.000.00) or less, subject to the provision that the original
contract price may not be increased by more than twenty -five percent (25 %) or decreased by more than twenty-five
percent (25 %) without the consent of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately from and ar passage by the City Council of
the City of Baytown.
