Ordinance No. 11,014ORDINANCE NO. 11,014 AN ORDINANCE OF THE CITY COUNCIL OP THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE PAYMENT OF Tl IB SUM OF SIXTY-ONE THOUSAND FIVE HUNDRED FIFTEEN AND NO/100 DOLLARS ($6! ,515.00) TO COBAN TECHNOLOGIES, INC. FOR NINE MOBILE DIGITAL VIDEO RECORDING DEVICES, ALL NECESSARY WORKSTATION/SERVER SOFTWARE/HARDWARE, AND INSTALLATION/ CONFIGURATION SERVICES FOR THE POLICE DEPARTMENT; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, Texas Local Government Code Annotated §252.022 provides that when liie functional requirements af the Cily can only he satisfied by one source, the requirement for competitive bids is not applicable: and WHEREAS, based upon the current Storage and management infrastructures llial llic Police Department lias in place, Cuban TopCam in-ear digilal video systems are the only compatible system on (he market that will work within the existing environment; and WHEREAS, trie procurement of nine mobile digilal video recording devices, all necessary workstation/server software/hardware, and installation/con figuration services for the Police Department can be satisfied by only one source, Coban Technologies, Inc.; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section I: That the City Council of the Ciiy of Baylown, Texas, hereby declares that only one source can satisfy the needs of the City for mobile digital video recording devices, all necessary worksl at ion/server software/hardware, and installation/configuration services for the Police Department. Section 2: That the City Council of the City of Baytown, Texas, authorizes payment of the sum of SIXTY- ONE THOUSAND FIVE HUNDRED FIFTEEN AND NO/1 (10 DOLLARS (361,515.00) to Coban Technologies, Inc., as llie sole source, for nine mobile digital video recording devices, all necessary workstation/server software/hardware, and instalkmon'configuralioii services for ihe Police Department Section 3: That pursuant to the provisions ofTexas Local Government Code Annotated § 252.018. the Cit\ Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of TWENTY-FIVE THOUSAND AND NO/100 DOLLARS ($25,000.00) or less, subject to the provision that the original contract price may not be increased by more than t\veni)-flve percent (25%) or decreased by more than twenty-five percent (25%) without the consent of tiie contractor lo such decrease.
