AN ORDINANCE OF Tl IE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING THE PAYMENT IN THE AMOUNT OF NINETY-THREE
THOUSAND SIX HUNDRED NINETY-FIVE AND NO/100 DOLLARS (S93.695.00)
TO THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY FOR THE
ANNUAL CONSOLIDATED WATER QUALITY FEES FOR THE CITY'S FOUR
WASTEWATER TREATMENT PLANTS; AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.
WHEREAS, the Texas Commission on Environmental Quality ("TCEQ") in response to the
Clean Water Act has established a program to assess the quality of the river basins of the State; and
WHEREAS. Senate Bill 818 requires ihe TCEQ to recover ihe reasonable cost of the assessment
program from wastewater treatment permit holders and water rights holders; and
WHEREAS, the Consolidated Water Quality Fees arc assessed annually end) October 31" and
imposed on each person holding a permit under the V.T.C.A., Water Code, §§26.001, el seq.; NOW
Therefore,
be it ordained by the city council of the city of baytown, texas:
Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes the
payment in the amount of NINETY-THREE THOUSAND SIX HUNDRED NINETY-FIVE AND
NO/100 DOLLARS ($93,695.00) to the Texas Commission on Environmental Quality for the Annual
Consolidated Water Quality Fees for ihe City's four Wastcwater Treatment Plants, including the
Northeast Wastcwalcr Treatment Plant.
Section 2: That the City Manager is hereby granted general authority to approve any change
involving a decrease or an increase in amount authorized in Section 1 hereinabove of TWENTY-FIVE
THOUSAND AND NO/100 DOLLARS ($25,000.00) or less; however, the original contract price may
not he increased by more than twenty-rive percent (25%) or decreased by more than twenty-five percent
(25%) without the consent of the Texas Commission on Environmental Quality to such decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
