AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
TERMINATING THE DISASTER DECLARATION; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.

WHEREAS, on the 10th day of September, 2008, the Mayor, pursuant to the Texas Government
Code, Chapter 418, of the "Texas Disaster Act,"' issued an order declaring a local state of disaster for the
City of Bay town resulting from the impending arrival of Hurricane Ike, which presented within the City
of Baytown an imminent threat of widespread or severe damage, injury, or loss of life or property and
severe economic and social disruption due to high winds and tidal surges and other public calamity
resulting therefrom; and
WHEREAS, §418.1 OS(b) of the Texas Government Code provides that a local slate of disaster
may not be continued for a period in excess of seven days without the consent of the governing body of
the political subdivision; and
WHEREAS, such disaster declaration was extended by the City Council of the City of Baytown
via Ordinance No. 10,957 on September 16, 2008; and
WHEREAS, the conditions necessitating the proclamation of a local state of disaster have been
largely mitigated; and
WHEREAS, the Texas Disaster Act provides that a local state of disaster may be terminated by
the governing body of the political subdivision; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1; That the declaration of a local slate of disaster described in the preamble
hereinabove is hereby terminated.
Section 2: This ordinance shall be filed promptly with the City Clerk, and shall be given
prompt and general publicity.
Sections: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
