Ordinance No. 10,938ORDINANCE NO. 10,938 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE REAL ESTATE PURCHASE CONTRACTS ON ANY OR ALL OF THE 17 PROPERTIES SUBJECT TO FEMA PROJECT # 1606-067 IN CONFORMANCE WITH THE APPROVED HAZARD MITIGATION GRANT PROGRAM FOR FEDERALLY DETERMINED REPETITIVE FLOOD LOSS PROPERTIES; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, on May 11,2007, Mayor Mundinger received notice from the Texas Governor's Division of Emergency Management that Baytown had been awarded a $1,401,877 grant under the Federal Hazard Mitigation Grant Program (the "Grant"); and WHEREAS, the purpose of this grant was to fund 75% of the purchase of up to 17 specific properties in Baytown that had experienced repeated flooding losses paid by the FEMA National Flood Insurance Program; and WHEREAS, the City has been working cooperatively with the property owners through the paperwork and process requirements of this federal program over the past 13 months and has five owners who have expressed interest in selling their property; and WHEREAS, the owners' participation is absolutely voluntary and they have the right not to participate at all as well as the unilateral right to withdraw from participation at any time up to execution of a purchase agreement with no penalty or cost; and WHEREAS, should the City purchase any of the properties subject to the Grant, the structures thereon will be demolished and the land dedicated as green space in perpetuity; and WHEREAS, the City Council desires that the City Manager proceed with the voluntary purchases and take appropriate actions necessary to comply with the Grant; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes and directs the City Manager to execute Real Estate Purchase Contracts on any or all of the following 17 properties subject to FEMA Project # 1606-067 in conformance with the approved Hazard Mitigation Grant Program for federally determined repetitive flood loss properties: Section 2: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
