Ordinance No. 10,915ORDINANCE NO. 10,915 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, GRANTING GRACEMONT HOUSE, INC., A VARIANCE FROM SECTION 126-386(B) OF THE CODE OF ORDINANCES, BAYTOWN, TEXAS, TO REDUCE THE PARKING REQUIREMENTS FROM THE REQUIRED 2.25 PARKING SPACES PER DWELLING UNIT TO 1.57 PARKING SPACES PER DWELLING UNIT; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, Gracemont House is an income controlled federal funded project for elderly and disabled residents; and WHEREAS, Gracemont House, Inc., has requested a variance from subsection (b) of Section 126-386 "Site Standards" of the Code of Ordinances, Baytown, Texas, to reduce the parking requirements from the required 2.25 parking spaces per dwelling unit to 1.57 parking spaces per dwelling unit; and WHEREAS, the requested variance, if granted, will reduce the number of required parking spaces from 32 to 22; and WHEREAS, subsection (c)(3) of Section 126-386 "Site Standards" of the Code of Ordinances, Baytown, Texas, allows the City Council, upon recommendation by the Planning and Zoning Commission, to adjust the parking requirements for controlled income and rent housing to fit demonstrated demand in similar projects; and WHEREAS, the Planning and Zoning Commission considered this request at its meeting held on June 18, 2008, and unanimously recommended approval; and WHEREAS, the City Council finds that the parking requirements should be adjusted based upon the demonstrated demand of similar projects; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: The findings contained in the preamble hereof are declared to be true and correct and are hereby adopted. Section 2: The following variance to the Code of Ordinances, Baytown, Texas, is hereby granted to Gracemont House, Inc., for its property described in a plat entitled Gracemont House and approved by the Baytown Planning and Zoning Commission on June 18, 2008: On-site parking shall be provided for residential development designated for rental occupancy at the rate of 1.57 spaces per dwelling unit. Section 3: The variance granted in Section 2 hereof shall expire if Gracemont House, Inc., does not obtain a building permit for the property for which the variance is granted within 180 days from the effective date of this ordinance. Section 4: Nothing herein shall be construed as to authorize any other variance, exception, or deviation from Chapter 126 of the Code of Ordinances, Baytown, Texas. Section 5: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
