Ordinance No. 10,795ORDINANCE NO. 10,795 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ADDING PORTIONS OF THE CEDAR BAYOU STREAM ANNEXATION TO COUNCIL DISTRICT NOS. 5 AND 6; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. WHEREAS, Section 17(1) of the Charter of the City of Baytown provides that the City Council shall redistrict the City if the growth of the City justifies; and WHEREAS, it is necessary to include the newly annexed territory described herein in a council district; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: Council District No. 5 is hereby rcdistricted by the addition of those properties north O'Neal Street, a private road, which is more particularly depicted in Exhibit "A," which is attached hereto and incorporated herein for all intents and purposes. Section 2: Council District No. 6 is hereby redistricted by the addition of those properties south O'Neal Street, a private road, which is more particularly depicted in Exhibit "A," which is attached hereto and incorporated herein for all intents and purposes. Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytq>*5n at least twice within ten (10) days after passage of this ordinance. East and parallel with the mean high tide line of the East bank of Cedar Bayou Main Stream, with its meanders, to a point of intersection with the Northern right-of-way of State Highway 99, THENCE, Westerly along the Northern right-of-way of State Highway 99 to a point of intersection with the mean high tide line of the West Bank of Cedar Bayou Main Stream, at 500.00 feet passing the mean high tide line of the East bank of Cedar Bayou Main Stream, THENCE, Northerly with the mean high tide line of the West bank of Cedar Bayou Main Stream, and its meanders, to a point of intersection of the mean high tide line of the West Bank of Cedar Bayou Main Stream with the Eastern right-of-way of State Highway 146 North, THENCE, Northeasterly with the Eastern right-of-way of State Highway 146 North to the mean high tide line of the Northeastern bank of Cedar Bayou Main Stream, to the POINT OF BEGINNING. SAVE AND EXCEPT Save and except those tracts or portions of tracts of land both situated in Baytown Industrial District 3 and currently subject to a City of Baytown Industrial District Agreement, and those portions of Cedar Bayou Main Stream and those tracts and/or portions of tracts of land currently within the incorporated limits of the City of Baytown, Texas.
