AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING THE PAYMENT OF ONE HUNDRED THIRTY THOUSAND ONE
HUNDRED SEVENTY-FIVE AND NO/100 DOLLARS ($130,175.00) TO RUSH
EQUIPMENT CENTER, HOUSTON, THROUGH THE HOUSTON-GALVESTON AREA
COUNCIL FOR THE PURCHASE OF ONE 2008 JOHN DEERE 310J BACKHOE
LOADER AND ONE 2008 JOHN DEERE 310SJ BACKHOE LOADER WITH
CONCRETE HAMMER; MAKING OTHER PROVISIONS RELATED THERETO; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the City Council of the City of Baytown has approved an Interlocal Agreement which
authorizes the Houston-Galveston Area Council to take bids for certain items on behalf of the City of
Baytown; and
WHEREAS, pursuant to such agreement, the Houston-Galveston Area Council has taken bids for
one (1) 2008 John Deere 310J backhoe loader and one (I) 2008 John Deere 310SJ backhoe loader with
concrete hammer; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby authorizes the payment of ONE
HUNDRED THIRTY THOUSAND ONE HUNDRED SEVENTY-FIVE AND NO/100 DOLLARS
($130,175.00) to Rush Equipment Center, Houston, through the Houston-Galveston Area Council for the
purchase of one (1) 2008 John Deere 310J backhoe loader and one (1) 2008 John Deere 31 OS J backhoe loader
with concrete hammer.
Section 2: That pursuant to the provisions of Texas Local Government Code Annotated
§252.048, the City Manager is hereby granted general authority to approve any change order involving a
decrease or an increase in costs of TWENTY-FIVE THOUSAND AND NO/100 DOLLARS (525,000.00) or
less, provided that the original contract price may not be increased by more than twenty-five percent (25%) or
decreased by more than twenty-five percent (25%) without the consent of the contractor to such decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
