AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
SETTING THE TIME, DATE AND PLACE OF THE PUBLIC HEARINGS ON THE
ANNEXATION OF PORTIONS OF CEDAR BAYOU STREAM AND THE 500-FOOT
STRIP OF LAND COMMENCING AT THE EASTERLY RIGHT-OF-WAY OF STATE
HIGHWAY 146 NORTH AND THE MEAN HIGH TIDE LINE OF THE EAST BANK
OF CEDAR BAYOU STREAM, THEN MEANDERING WITH THE EAST BANK OF
CEDAR BAYOU STREAM TO A POINT OF INTERSECTION WITH THE MEAN
HIGH TIDE LINE OF THE EAST BANK OF CEDAR BAYOU STREAM AND
HIGHWAY 99; PROVIDING FOR THE REQUISITE NOTICES AND
PUBLICATIONS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: On the 25lh day of October, 2007, at the regularly scheduled meeting of the City
Council, which commences at 6:30 p.m., in the City Hall Council Chambers of the City of Baytown, 2401
Market Street, Baytown, Texas, the City Council will hold public hearings giving all interested persons
the opportunity to speak regarding the proposed annexation of portions of Cedar Bayou Stream and the
500-foot strip of land commencing at the easterly right-of-way of State Highway 146 North and the mean
high tide line of the east bank of Cedar Bayou Stream, then meandering with the east bank of Cedar
Bayou Stream to a point of intersection with the mean high tide line of the east bank of Cedar Bayou
Stream and Highway 99.
Section 2: Before the 30th day before the date of the first public hearing, the City Clerk of the
City of Baytown is hereby authorized and directed to give written notice of the City's intent to annex the
area to:
(1) each property owner in the area proposed for annexation, as indicated by the appraisal
records furnished by the appraisal district for each county in which the area is located;
(2) each public entity or private entity that provides services in the area proposed for
annexation; and
(3) each railroad company that serves the City and is on the City's tax roll if the company's
right-of-way is in the area proposed for annexation.
Section 3: The City Clerk of the City of Baytown is hereby authorized and directed to offer a
development agreement to each property owner on whose property is appraised for ad valorem tax
purposes as land for agricultural or wildlife management use under Subchapter C or D, Chapter 23, Tax
Code, or as timber land under Subchapter E of that chapter. A copy of such development agreement is
attached hereto as Exhibit "A" and incorporated herein for all intents and purposes.
Section 4: The City Clerk of the City of Baytown is hereby authorized and directed to provide
written notice of the proposed annexation to each public school district located in the area proposed for
annexation not less than ten (10) days prior to the date of the public hearings.
Section 5: The City Clerk of the City of Baytown is hereby authorized and directed to cause
notice of such public hearings to be published once in the newspaper having general circulation in the
City and in the area proposed for annexation not less than ten (10) days prior to the date of the public
hearings.
Section 6: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown. i '1
