AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, ADDING A 1.0941 ACRE TRACT OF LAND SITUATED IN THE W.
C. RAILROAD COMPANY SURVEY, ABSTRACT 899, HARRIS COUNTY,
TEXAS, AND BEING OUT OF AND A PART OF THAT CERTAIN CALLED
126.735 ACRE TRACT (TRACT ONE) CONVEYED BY FLORENCE
GODFREY, ET AL, TO GARTH-ARCHER, CHARLES H. GRUBE, LTD, BY
DEED DATED FEBRUARY 15, 1973, AND RECORDED UNDER COUNTY
CLERK'S FILE NO. D806833 OF THE DEED RECORDS OF HARRIS
COUNTY, TEXAS, TO COUNCIL DISTRICT NO. 4; REPEALING
ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS
CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE
DATE THEREOF.
WHEREAS, Section 17(1) of the Charter of the City of Baytown provides that the City
Council shall redistrict the City if the growth of the City justifies; and
WHEREAS, it is necessary to include the newly annexed territory described herein in a
Council District; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: Council District No. 4 is hereby redistricted by the addition of that
property which is described in Exhibit "A," which is attached hereto and incorporated herein for
all intents and purposes.
Section 2: All ordinances or parts of ordinances inconsistent with the terms of this
ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of
such inconsistency and in all other respects this ordinance shall be cumulative of other
ordinances regulating and governing the subject matter covered by this ordinance.
Section 3: If any provisions, section, exception, subsection, paragraph, sentence,
clause or phrase of this ordinance or the application of same to any person or set of
circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall
not affect the validity of the remaining provisions of this ordinance or their application to other
persons or sets of circumstances and to this end all provisions of this ordinance are declared to be
severable.
Section 4: This ordinance shall take effect from and after ten (10) days from its
passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing
the caption of this ordinance to be published in the official newspaper of the City of Baytown at
least twice within ten (10) days after passage of this ordinance.

ANNEXATION FIELD NOTES) -
FIELD NOTES of a 1.0941 acre iract of land situated in the W. C. Railroad Company
Survey, Abstract 899, Harris County, Texas and being out of and a part of that certain
called 126.735 acre tract (Tract One) conveyed by Florence Godfrey, et a!, to Garth-
Archer, Charles H. Grube, LTD, by Deed dated February 15,1973 and recorded under
County Clerk's File No. D806833 of the Deed Records of Harris County, Texas. This
1.0941 acre tract of land is more particularly described by the following metes and
bounds, to-wit:
NOTE: ALL BEARINGS ARE LAMBERT GRID BEARINGS AND ALL
COORDINATES REFER TO THE STATE PLANE COORDINATE SYSTEM, SOUTH
CENTRAL ZONE, NAD 83. ALL DISTANCES ARE ACTUAL DISTANCES.
SCALE FACTOR -0.9998832.
COMMENCING at a point in the East right-of-way line of Garth Road (right-of-way
width varies) at the Southwest comer of the residue of that certain 4.5856 acre tract of
land conveyed by Garth-Archer, Charles H. Grube, LTD to Diamond Shamrock Corp. by
Deed dated April 1,1977 and recorded under County Clerk's File No. F101300 of the
Deed Records of Harris County, Texas and the Southeast comer of that certain 0.0S8 of
an acre conveyed by Diamond Shamrock Corp. to County of Harris by Deed dated
November 14,1978 and recorded under County Clerk's File No. F952906 of the Deed
Records of Harris County, Texas. Said point being in the West line of the residue of said
called 126.735 acres and being the Northwest comer of a 2.4893 acre tract surveyed this
date. Said COMMENCING POINT has a State Plane Coordinate of X=3,243,354.24 and
Y-13,857,303.34.
THENCE: North 77°48'11" East along the North line of said 2.4893 acre tract and the
South line of said 4.5856 acres for a distance of 128.34 feet to a point for an angle point
in said line.
THENCE: North 39°40'52" East along the North line of said 2.4893 acres and the South
line of said 4.5856 acres for a distance of 157.14 feet to a point in the existing City Limits
of the City of Baytown, Texas for the Northwest comer and POINT OF BEGINNING of
this tract.
THENCE: Continue North 39°40'52" East along the North line of this tract, the North
line of said 2.4893 acres and the South line of said 4.5856 acres for a distance of 152.40
feet to a point for the Northeast comer of this tract and the Northeast comer of said
2.4893 acres.
THENCE: South 12° 15'44" East along the East line of this tract and the East line of said
2.4893 acres for a distance of 415.16 feet to a point for the Southeast comer of this tract
and the Southeast comer of said 2.4893 acres.

THENCE-South 77°44t16" West along the South line of this tract and the South line of
said 2.4893 acres for a distance of 141.64 feet to a point for the Southwest comer of this
tract in the existing City Limits of the City of Baytown, Texas.
THENCE: North 08°24*24" West along the West line of this tract and along the existing
City Limits of the City of Baytown, Texas, over and across said 2.4893 acres, for a
distance of 321.94 feet to the PLACE OF BEGINNING and containing within these
boundaries 1.0941 acres of land.
