Ordinance No. 10,669ORDINANCE NO. 10,669 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, APPROVING THE BAWA RAW WATERLINE PROJECT BETWEEN THE BAYTOWN AREA WATER AUTHORITY AND ALVIN CONTRACTING; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the Board of Directors of the Baytown Area Water Authority ("BAWA") advertised for bids for the BAWA Raw Waterline Project to be received on May 22,2007; and WHEREAS, notice to bidders as to the time and place, when and where the contract would be let was published in accordance with law; and WHEREAS, all bids were opened and publicly read at the Baytown Area Water Authority's Fritz Lanham Water Treatment Facility on May 22, 2007, as per published notice to bidders; and WHEREAS, on May 22, 2007, BAWA only received one bid, which was higher than the engineering estimate; and WHEREAS, BAWA then re-advertised for bids for the BAWA Raw Waterline Project to be received on June 28,2007; and WHEREAS, notice to bidders as to the time and place, when and where the contract would be let was published in accordance with law; and WHEREAS, all bids were opened and publicly read at the Baytown Area Water Authority's Fritz Lanham Water Treatment Facility on June 28, 2007, as per published notice to bidders; and WHEREAS, BAWA received five bids; the lowest bidder submitted a bid of SEVENTY- SIX THOUSAND FOUR HUNDRED SIXTY AND NO/100 DOLLARS ($76,460.00), which was a savings of NINETEEN THOUSAND FIVE HUNDRED FORTY AND NO/100 DOLLARS ($19,540.00); and WHEREAS, on July 18, 2007, the Board of Directors of the Baytown Area Water Authority rejected the bid received on May 22,2007, for the BAWA Raw Waterline Project, and accepted the bid of Alvin Contracting for the Project, including Alternate Bid Item No. 1, in the sum of SEVENTY-SIX THOUSAND FOUR HUNDRED SIXTY AND NO/100 DOLLARS ($76,460.00); and WHEREAS, the legislation creating BAWA requires that the City Council of the City of Baytown approve contracts entered into by BAWA; and WHEREAS, the City Council of the City of Baytown believes that such contract is desirable, fair, and advantageous, for the performance of the BAWA's rights and powers; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby approves the BAWA Raw Waterline Project, including Alternate Bid Item No. 1, between the Baytown Area Water Authority and Alvin Contracting. Section 2: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
