Ordinance No. 10,664ORDINANCE NO. 10,664 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, SETTING A DATE, TIME AND PLACE FOR A PUBLIC HEARING ON THE QUESTION OF WHETHER THE CITY SHOULD TAX GOODS-IN-TRANSIT EXEMPT UNDER HOUSE BILL 621; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, in the 2007 session, the Texas Legislature passed HB 621, which is the implementing legislation for a constitutional amendment that was passed several years ago; and WHEREAS, HB 621 exempts goods, principally inventory, that are stored in a location that is not owned by the owner of the goods and are transferred from that location to another location within 175 days; and WHEREAS, HB 621, however, provides that the governing body of each taxing unit may act to tax these goods in the year following the year in which the governing body takes action; and WHEREAS, these goods will first become eligible for an exemption in 2008 under HB 621; and WHEREAS, before any action regarding the taxation of goods-in-transit is taken by the City Council, the City Council must hold a public hearing at which members of the public are permitted to speak for or against such taxation; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: On the 9lh day of August, 2007, at the regularly scheduled meeting of the City Council, which commences at 6:30 p.m., in the City Hall Council Chambers of the City of Baytown, 2401 Market Street, Baytown, Texas, the City Council will hold a public hearing giving all members of the public the opportunity to speak for or against the taxation of goods-in-transit exempt under House Bill 621. Section 2: The City Clerk of the City of Baytown is hereby authorized and directed to cause notice of such public hearing to be published once in the newspaper having general circulation in the City and in the above-described territory not less than seven (7) days prior to the date of the public hearing. Section 3: This ordinance shall take effect immediately Jpm and after its passage by the City Council of the City of Baytown.
