BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Chapter 18 "Buildings and Building Regulations," Article II "Building Construction Standards," Division 3 "Building Code," Section 18-91 "Adopted," Subsection (a) of the Code of Ordinances, Baytown, Texas, is hereby amended to read as follows: CHAPTER 18. BUILDINGS AND BUILDING REGULATIONS ARTICLE II. BUILDING CONSTRUCTION STANDARDS DIVISION 3. BUILDING CODE Sec. 18-91. Adopted. (a) Except as provided in this division, the International Building Code, 2006 edition, published by the International Code Council, Inc., as amended in section 18-92, is adopted and incorporated as fully as if set forth at length in this section and the provisions therein shall be controlling in the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use and maintenance of buildings and structures within the city limits. One copy of the building code is on file in the office of the city clerk. Section 2: That Chapter 18 "Buildings and Building Regulations," Article IV "Plumbing Code," Section 18-461 "Adopted," Subsection (a) of the Code of Ordinances, Baytown, Texas, is hereby amended to read as follows: CHAPTER 18. BUILDINGS AND BUILDING REGULATIONS ARTICLE IV. PLUMBING CODE Sec. 18-461. Adopted. (a) The International Plumbing Code, 2006 edition, published by the International Code Council, Inc., as amended in section 18-462, is adopted as the plumbing code of the city and is made a part of this article for all intents and purposes. One copy of the plumbing code is on file in the office of the city clerk. Section 3: That Chapter 18 "Buildings and Building Regulations," Article V "Mechanical Code," Division 3 "Standards," Section 18-556 "Code adopted," Subsection (a) of the Code of Ordinances, Baytown, Texas, is hereby amended to read as follows: CHAPTER 18. BUILDINGS AND BUILDING REGULATIONS ARTICLE V. MECHANICAL CODE DIVISION 3. STANDARDS Sec. 18-556. Code adopted. (a) The International Mechanical Code, 2006 edition, as published by the International Code Council, Inc., as amended in section 18-557, is adopted as the mechanical code of the city and is made a part of this article for all intents and purposes. A copy of the mechanical code is filed in the office of the city clerk. Section 4: That Chapter 18 "Buildings and Building Regulations," Article VI "International Fuel Gas Code," Division 2 "Standards," Section 18-622 "Code adopted," Subsection (a) of the Code of Ordinances, Baytown, Texas, is hereby amended to read as follows: CHAPTER 18. BUILDINGS AND BUILDING REGULATIONS ARTICLE VI. INTERNATIONAL FUEL GAS CODE DIVISION 2. STANDARDS Sec. 18-622. Code adopted. (a) The city adopts the International Fuel Gas Code, 2006 edition, published by the International Code Council, Inc., as amended in section 18-623. A copy of the fuel gas code is filed in the office of the city clerk. Section 5: That Chapter 18 "Buildings and Building Regulations," Article VII "International Property Maintenance Code," Division 2 "Standards," Section 18-625 "Code adopted," Subsection (a) of the Code of Ordinances, Baytown, Texas, is hereby amended to read as follows: CHAPTER 18. BUILDINGS AND BUILDING REGULATIONS ARTICLE VII. INTERNATIONAL PROPERTY MAINTENANCE CODE DIVISION 2. STANDARDS Sec. 18-625. Code adopted. (a) The city adopts the International Property Maintenance Code, 2006 edition, published by the International Code Council, Inc., as amended in section 18-626. A copy of the property maintenance code is filed in the office of the city clerk. Section 6: That Chapter 18 "Buildings and Building Regulations," Article VIII "International Energy Conservation Code," Division 2 "Standards," Section 18-628 "Code adopted," Subsection (a) of the Code of Ordinances, Baytown, Texas, is hereby amended to read as follows: CHAPTER 18. BUILDINGS AND BUILDING REGULATIONS ARTICLE VIH. INTERNATIONAL ENERGY CONSERVATION CODE DIVISION 2. STANDARDS Sec. 18-628. Code adopted. (a) The city adopts the International Energy Conservation Code, 2006 edition, published by the International Code Council, Inc. A copy of the energy conservation code is filed in the office of the city clerk. Section 7: That Chapter 18 "Buildings and Building Regulations," Article IX "Minimum Property Standards," Division 2 "Standards," Section 18-651 "Residential code adopted," Subsection (a) of the Code of Ordinances, Baytown, Texas, is hereby amended to read as follows: CHAPTER 18. BUILDINGS AND BUILDING REGULATIONS ARTICLE IX. MINIMUM PROPERTY STANDARDS DIVISION 2. STANDARDS Sec. 18-651. Residential code adopted. (a) The 2006 edition of the International Residential Code, as amended in section 18-652, is adopted and incorporated as fully as if set forth at length in this section and the provisions therein shall be controlling in the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of one-and two-family dwellings and townhouses in the city. A copy of this code is on file in the office of the city clerk. Section 8: That Chapter 18 "Buildings and Building Regulations," Article IX Vi "International Existing Building Code," Division 2 "Standards," Section 18-765 "Adopted," Subsection (a) of the Code of Ordinances, Baytown, Texas, is hereby amended to read as follows: CHAPTER 18. BUILDINGS AND BUILDING REGULATIONS ARTICLE IX Vi. INTERNATIONAL EXISTING BUILDING CODE DIVISION 2. STANDARDS Sec. 18-765. Adopted. (a) Except as provided in this division, the International Existing Building Code, 2006 edition, published by the International Code Council, Inc., as amended in section 18-766, is adopted and incorporated as fully as if set forth at length in this section and the provisions therein shall be controlling in the repair, alteration, change of occupancy, addition and relocation of existing buildings and structures within the city limits. One copy of the code is on file in the office of the city clerk. Section 9: That Chapter 38 "Fire Prevention and Protection," Article III "Fire Prevention Standards," Section 38-61 "Code adopted," Subsection (a) of the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as follows: CHAPTER 38. FIRE PREVENTION AND PROTECTION ARTICLE IH. FIRE PREVENTION STANDARDS Sec. 38-61. Code adopted. (a) Except as may otherwise be provided in this chapter, the International Fire Code, 2006 edition, published by the International Code Council, Inc., as amended in section 38-62, is adopted and incorporated as fully as if set forth at length in this section. The fire prevention code adopted in this section shall be controlling within the city limits. One copy of the code is on file in the office of the city clerk. Section 10: That Chapter 38 "Fire Prevention and Protection," Article III "Fire Prevention Standards," Section 38-62 "Definitions" of the Code of Ordinances, City of Baytown, Texas, is hereby amended to add a new Subsection (c) which shall read as follows: CHAPTER 38. FIRE PREVENTION AND PROTECTION ARTICLE HI. FIRE PREVENTION STANDARDS Sec. 38-62. Definitions; amendments. (c) The fire prevention code adopted in section 38-61 is hereby amended, in part, as follows: Section. 503.2.3 Surface is amended to read as follows: Fire apparatus access roads shall be constructed of asphalt, concrete, or such other hard, all- weather surface material as approved by the fire code official. Fire apparatus access roads shall be constructed and matained so as to withstand the load of fire apparatus without failure. Section 508.5.1 Where required is amended to read as follows: Where a portion of the facility or building constructed hereinafter or moved into or within the city is more than 300 feet from a hydrant on a fire apparatus access road, as measured by an approved route around the exterior of the facility or building, on-site fire hydrants and mains shall be provided where required by the fire code official. Exceptions: 1. For Group R-3 and Group U occupancies, the distance required shall be 500 feet. 2. For buildings equipped throughout with an approved automatic sprinkler system installed in accordance with Section 903.3.1.1 or 903.3.1.2, the distance requirement shall be 500 feet. Section 903.3.6 Hose threads is amended to read as follows: Fire hose threads and standpipes used in connection with automatic sprinkler systems shall be approved by the fire code official and shall be compatible with fire department hose threads. 9033.6.1 A 5" (5 inch) Storz connection, with caps, shall be used for all fire department connections where a NFPA 13 (commercial) sprinkler system or any standpipc system is installed. 9033.6.2 A 2 !4" (2 Vi inch) NST female connection, with caps, may be used for fire department connections where a NFPA 13D or 13R sprinkler system is installed. Section 912.1 Installation is amended to read as follows: 912.1 The type, size and location of fire department connections shall be approved by the fire code official. Section 912.2 Location is amended to add the subsections which shall read as follows: 912.2.2 Where NFPA 13 sprinkler systems or standpipe systems or installed, the fire department connection shall be located remote of the building, out of the collapse zone. The collapse zone is a distance away from the building at least equal to the height of the exterior wall of the building, on the side of the fire department connection. 912.2.3 The remote fire department connections shall be at a 45-degree downward angle to the ground and shall be at least 24 inches from the ground and no higher than 36 inches from the ground. 912.2.4 All fire department connections shall be located: 1. no more than SO feet from fire department access and 2. no more than 100 feet from an accessible fire hydrant. 912.2.5 When barriers such as, but not limited to, ditches or fences are present, then access points shall be provided to maintain the SO foot travel distance between the fire department connection and the fire department access road. Access points may consist of a gate or pathway, at grade, at least 4 feet wide. Section 912.4 Signs is amended to read as follows: 912.4 A posted sign, in accordance with the fire code official's requirements, must identify all fire department connections. 912.4.1 Number and type of sign required. One header sign is required for buildings that have one address, one sprinkler system, and one fire department connection. Header and locator signs are required for buildings that have multiple addresses, multiple sprinkler systems, or multiple fire department connections. 912.4.2 Requirements of a header sign. A header sign must be clearly visible and must: 1. be metal with square comers 2. be 18" x 24" in size; 3. be mounted 8 to 10 feet above grade and centered on the fire department connection; 4. have a red background with reflective white lettering; and 5. contain the following verbiage: a. "F.D.C." in 6-inch lettering on the first line of the sign; b. "Sprinkler," "Standpipe," and/or "Test Connection," as appropriate, in 3-inch lettering on the second line of the sign; c. the street number of the address of the structure in 4-inch lettering on the third line of the sign; and d. The street name in 3-inch high lettering on the fourth line of the sign. 912.4.3 Requirements of a locator sign. A locator sign must be clearly visible and must: 1. be metal with square corners 2. be 18" x 24" in size; 3. be mounted 12 inches above the individual fire department connection; 4. have a white background with reflective red lettering 5. designate what areas are serviced by the corresponding fire department connection; and 6. contain the following: a. "F.D.C." in 6" lettering on the first line of the sign; and b. type of connection and area served in 3" lettering. 912.4.4 Existing Buildings. All owners of existing buildings within the city containing a NFPA 13 or 13R sprinkler system or a standpipe must comply with the signage requirements contained in this section 912.4 on or before August 1, 2009. Section 11: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 12: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of the ordinance or the application of same to any person or the set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not effect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 13: Any person who fails to comply with any provision of Sections 1 through 8 of this ordinance shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine not exceeding FIVE HUNDRED AND NO/100 DOLLARS ($500.00). Any person who fails to comply with any provision of Sections 9 or 10 of this ordinance shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine not exceeding TWO THOUSAND AND NO/100 DOLLARS ($2,000.00). Each act of violation and each day upon which any such violation shall occur shall constitute a separate offense. In addition to the penalty prescribed above, the city may pursue other remedies such as abatement of nuisances, injunctive relief, administrative adjudication and revocation of licenses or permits. Section 14: This Ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Bay town at least twice within ten (10) days after passage of this ordinance.
