Ordinance No. 10,626ORDINANCE NO. 10,626 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING ORDINANCE NO. 10,449, PRESCRIBING THE NUMBER OF POSITIONS IN THE CLASSIFICATION "SERVICE GROUP - POLICE"; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City Council of the City of Baytown entered into an agreement with the Baytown Crime Control and Prevention District ("CCPD") to increase the number of positions in the classification Sergeant and to decrease the number of positions in the classification Patrol Officer for a Public Safety Operations Program during Fiscal Year 06-07; and WHEREAS, in furtherance of such Public Safety Operations Program, the CCPD has agreed to reallocate the funds to be provided to the City during Fiscal Year 06-07 to reprogram the positions as noted above; and WHEREAS, the Chief of Police recommends that moving one Patrol Officer position to that of Sergeant will enable him to assign his more senior officers to specialized public safety operations, which is consistent with the agreement between the City and CCPD; and WHEREAS, Section 143.021 (a) of the Texas Local Government Code requires that the City Council by ordinance prescribe the number of positions in each classification; and WHEREAS, the City Council last prescribed the number of positions in each classification of the Police Department on October 12, 2006, via Ordinance No. 10,449 as follows: Chief of Police 1 Assistant Chief/Captain 4 (In accordance with Chapter 143 of the Texas Local Government Code, 3 appointed captain positions and 1 tested captain position) Lieutenant 6 Sergeant 14 Patrol Officer 116 WHEREAS, the City Council now desires to reprogram one position in the Classification of Patrol Officer to a position in the Classification of Sergeant; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Section 1 of Ordinance 10,449, passed the 12th day of October, 2006, relating to the number of positions in the Classification "Service Group-Police," is hereby amended to read as follows: That the number of positions in each classification in the police department shall be as follows: Chief of Police 1 Assistant Chief/Captain 4 (In accordance with Chapter 143 of the Texas Local Government Code, 3 appointed captain positions and 1 tested captain position) Lieutenant 6 Sergeant 15 Patrol Officer 115 Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or the set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
