Ordinance No. 10,582ORDINANCE NO. 10,582 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, PRESCRIBING THE NUMBER OF POSITIONS IN EACH CLASSIFICATION IN THE FIRE DEPARTMENT; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, previously, the Chief of the City of Baytown Fire Department has recommended to the City Council that certain positions in the Fire Department be reclassified and renamed; and WHEREAS, the last such recommendation was approved by the City Council on the 12lh day of January, 2006, via Ordinance No. 10,245 wherein the number of persons in each classification of the Fire Department was established as follows: Fire Chief 1 Assistant Fire Chief. 3 (Subject to provisions enacted by Ordinance No. 8355) Fire Battalion Chief. 5 Lieutenant 17 Fire Equipment Operator 15 Fire Fighter 51; and WHEREAS, to promote greater efficiency in the City's Fire Department, the City desires to add another Lieutenant position; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the number of positions in each classification in the fire department shall be as follows: Fire Chief 1 Assistant Fire Chief. 3 (Subject to provisions enacted by Ordinance No. 8355) Fire Battalion Chief. 5 Lieutenant 18 Engineer 15 Fire Fighter 51 Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or the set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytovvn.
