Ordinance No. 10,567ORDINANCE NO. 10,567 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING THE COMMUNITY DEVELOPMENT BLOCK GRANT ANNUAL ACTION PLAN FISCAL YEAR 2006-2007 AND MAKING A CHANGE IN THE CITY OF BAYTOWN'S FISCAL YEAR 2006-2007 BUDGET FOR MUNICIPAL PURPOSES IN ORDER TO REPROGRAM FUNDS IN THE CONTINGENCY FUND OF THE COMMUNITY DEVELOPMENT BLOCK GRANT FUND 270 FOR THE RESIDENTIAL SEWER LINE REPAIR AND REPLACEMENT PROGRAM; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the Community Development Block Grant ("CDBG") Annual Action Plan FY2006-2007 was approved by City Council on July 13, 2006, and included in the City's budget documents; and WHEREAS, on February 8, 2007, City Council approved guidelines for the Residential Sewer Line Repair and Replacement Program (the "Program"); and WHEREAS, in order to fund the Program using CDBG funds, the current Annual Action Plan must be amended and the budget must be changed; and WHEREAS, the City staff published a public notice for 30 days, as required by HUD, on the City's website and in the Baytown Sun to make the public aware of the proposed amendment to the CDBG Annual Action Plan; and WHEREAS, the City received no comments regarding the proposed amendment; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: The City Council hereby amends the Community Development Block Grant Annual Action Plan Fiscal Year 2006-2007 to provide funding in an amount not to exceed THIRTY THOUSAND AND NO/100 DOLLARS for the Residential Sewer Line Repair and Replacement Program. A copy of such amended plan is attached hereto as Exhibit "A" and incorporated herein for all intents and purposes. Section 2: That the City Council of the City of Baytown hereby changes the City of Baytown's Fiscal Year 2006-07 budget for municipal purposes to reprogram THIRTY THOUSAND AND NO/100 DOLLARS (S30.000.00) in the Contingency Fund of the Community Development Block Grant Fund 270 for the Residential Sewer Line Repair and Replacement Program, as more particularly described in Exhibit "B," which is attached hereto and incorporated herein for all intents and purposes. Section 3: This resolution shall take effect immediately from and^er its passage by the City Council of the City of Baytown, Texas.
