Ordinance No. 10,535ORDINANCE NO. 10,53 5 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING THE BID OF YMCA OF THE GWTER HOUSTON AREA D/B/A BAYTOWN FAMILY YMCA FOR THE ANNUAL LIFEGUARD SERVICES CONTRACT AND AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN, THE SUM OF SIXTY THOUSAND FOUR HUNDRED FORTY-EIGHT AND NOllOO DOW ($60,448.00); MAKING OTHER PROVISIONS RELATED THEEGXO; AND PROVIDING FQR THE EFFECTIVE DATE THEREOF. WHEREAS, the City Coun~iI of the City of Baytown did authorize the Purchasing Depment for the City of Baytown lo advertise for bids for the Annual Lifeguard Services Contract to be received January 9, 2007; and WHEREAS, notice to bidders as to the time and place, when and where the contract would be let was pubiished pursuant to the provisions of Chapter 252 of the Texas Local Government Code; and WHEREAS, all bids were opened and publicly read at City Hall at 2:OO p.m., Tuesday, January 9, 2007, as per published norice to bidders: NOW THEREFORE BE IT ORDAINED BY THE ClTY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1 : That the City Council of the City of Baytom hereby accepts fie bid of YMCA of the Greater Houston Area d/b/a Baytom Family YMCA forthe Annual Lifegmrd Services Contract for the sum of SIXTY THOUSAND FOUR HUNDRED FORTY-EIGHT AND N0/1110 DOLLARS (%0,448.00) and authorizes payment thereof. Section 2: That pursuant to the provisions of Texas Ld Government Code Annotated 4252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of TWENTY-FIVE THOUSAND AM3 NQ/I 00 DOLLARS ($25,000.00) or less, subject to the provision that the original contract price may not be increased by more than twenty- five percent (25%) or decreased by more than twenty-five percent (25%) without the consent of the cwnmctor to such decrease. Section 3: Thrs ordinance shall take effect immediately from and by the City Council of the City of Baytawn.
