Ordinance No. 10,534ORDINANCE NO. 10,534 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE PAYMENT OF FORTY THOUSAND NINE HUNDRED FOUR AND 9Zl00 DOLLARS ($40,904.92) TO CALENCE, LLC, FOR THE AWAL ClSCO SMARTNET (HARDWARE AND SOFTWARE) MAINTENANCE AGREEMENT FOR THE PERIOD OF JANUARY 4 2007, THROUGH JANUARY 3,2008; MAIWG OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City of Baytown is a member of the cooperative purchasing prngram established under Sections 27 1.082 and 271 .a83 of the Texas Local Government Code; and WHEREAS, the Computer hformation Systems Vendor Program is such a program, allowing municipalities to purchase automated information systems products andor services in m efficient, cost effective, and competitive procurement method; and WHEREAS, the City sf Baytown in making a purchase under a state contract through such cooperative purchasing program satisfis state law requiring municipalities to seek competitive bids fur the purchase of the item; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE crm OF BAYTOWN* TEXAS: Section 1 : That the City Council of the City of bytown hereby authorizes the payment of FORTY THOUSAND NINE HUNDRED FOUR AND 921 100 DOLLARS ($40,904.92) to Calence, LLC, far the Annual Cisco Smarhlet (hardware and sohare) Maintenance Agreement for the period of January 4, 2007, through January 3,2008. Section 2: That the City Manager is hereby granted general authority to approve my change order involving a decrease or an increase in costs of TWENTY-FIVE THOUSAND AND NO1100 DOLLARS ($25,000,00) or less, provided that the original contract price may not be increased by more than twenty-five percent (25Or6) or decreased by more than twenty- five percent (25%) without the consent of the contractor to such decrease.
