Ordinance No. 10,525ORDINANCE NO. 10.525 AN ORDINANCE AUTHOFUING THE PAYMENT OF THE SUM OF THIRTY- FIVE THOUSAhm FOUR HUNDRED EIGHTY AND Not100 DOLLARS ($35.480.00) TO R4E SYSTEICIS. EC., AS THE SOLE SOURCE FOR A HAZARDOUS MATERIALS GAS DETECTION SYSTEM; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS. the purchase of a hazardous ~naterials gas detection systenl will greatly e~lhance the level of protection for citizens of and visitors to the City of Baytown and the responders during long-tenn hazardous materials incidents; and WHEREAS. such system will enable the City's hazardous tnaterials team to contin~~ously sanlple for toxic and flammable gases utilizing four field detection devices, with the resulting data displayed and recorded at a remote conlmand post; and WHEREAS, Texas Local Government Code Annotated 8 252.022 provides that when the runctional requirenlents of the City can only be satisfied by one source, the requirement for competitive bids is not applicable: and WHEREAS. the procurement of a hazardous materials gas detection system can bc satis tied by only otie source. RAE Systems, Inc.; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1 : That the City Co~incil of the City of Baytown, Texas, hereby declares that only one source can satisfy the needs of the City for a hazardous materials gas detection system. Section 2: That payment to RAE Systems. Inc., as the sole source, of THIRTY-FIVE 'fHOUSAND FOUR HUNDRED EIGHTY AND Not1 00 DOLLARS ($35,480.00) for a hazardous materials gas detection system is hereby authorized. Section 3: That pursuant to the provisions ofTexas Local Government Code Annotated tj 252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of TWENTY-FIVE THOUSAND AND NO1100 DOLLARS ($25,000.00) or less, subject to the provision that the original contract price may not be increased by more than twenty-five percent (25%) or decreased by more than twenty-five percent (25%) without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect i~nrnediately horn and after its passage by the City Coiincil of the City of Baytown.
