AN ORDINANCE OF THE ClTY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
ACCEPTING THE BID OF MEGASAND ENERPRISES, INC., FOR THE ANNUAL
CEMENT STABILIZED SANa CONTRAm AND AUTHORIZING PAYMJ2NT BY THE
CITY OF BAYTOWN, TIE SUM OF ONE HUNDRED SIXTY-EIGHT THOUSAND
NINE HUNDRED SEVENTY AND NO1 100 DOLLARS ($168,970.00); MAHUNG OTHER
PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
WHEREAS, the City Council of the City of Baytown did autfiwize the Purchasing Department for he
Ciry of Baytown to advertise for bids for the Annual Cement Stabilized Sand Contract to be received
December 12,2006; and
WHEREAS, notice to bidders as to the time and place, when and where the contract would be let was
pub1 ished pursuant to the provisions of Chapter 252 of the Texas Local Government Code; and
WHEREAS, all bids were opened and public1yTead at City Hall at 2:00 p.m., Tuesday, December 12,
2006, as per published notice to bidders; NOW -FORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: Tbat the City Council of the City of Baytown hereby accepts the hid of Megasand
Enterprises, Inc., for the Annual Cement Stabilized Sand Contract for the sum of ONE HUNDRED SXTY-
EIGHT THOUSAND NINE HUNDm SEVENTY AND N0/100 DOLLARS (IF 168,970.00) and authorizes
payment thereof.
Section 2: That pursuant to the provisions of Texas Local Government Code Annotated
$252.048, the City Manager is hereby granted general authmity to approve any change order involving a
decrease or an increase in costs of TWENTY-FIVE THOUSAND AND NOJl00 DOLLARS ($25,000.00) or
less, subject to the provision that the ori@ conact price may not be increased by more than twmly-five
percent (25%) or decmsed by more than twenty-five percent (25%) without the consent of the contractor ta
such decrease.
Section 3: This ordinance shall take effect immediately from and passage by the City
Council of the City of Baytown.
