Ordinance No. 10,523ORDINANCE NO. 10,523 AN ORDMANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING WE BID OF FERGUSON WATERWORKS, INC., FOR THE ANNUAL BRASS FI?TINGS CONTRACT AND AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN, THE SUM OF FORTY-EIGHT THOUSAND ONE HUNDRED FIFTY- FOUR AND NOll 00 DOLLARS ($48,154.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City Council of the City of Baytown did authorize the Purchasing Deparbnent for the City of Baytown to advertise for bids for the Annual Brass Fitting Contract to be received December 12, 2006; and WHEREAS, notice to bidders as to the -time and place, when and where the con tract would be let was published pursuant to the provisions of Chapter 252 of the Texas Local Govment Code: and WHEREAS, all bids were opened and publicly read at City Hal1 at 2:OO p.m., Tuesday, Dmmbm 12, 2006, as per published notice to bidders; NOW THEREFORE BE IT ORDW BY THE CITY COUNCIL, OF THE CITY OF BAYTOWN, TEXAS: Section 1 : That the City Council of the City of Baytom hereby accepts the bid of Ferguson Waterworks, Inc., far the Annual Bms Fittings Contract fa the sum of FORTY-EIGHT THOUSAND QNE HUNDRED FFN-FOUR AND NO/ 100 DOLLARS ($48,154.00) and authorizes papent thereof. Section 2: That pwant to the provisions af Texas Lo~al Government Code Annotated $252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of TWENIT-FWE THOUSAND AND NO/ 100 DOLLARS ($25,000.00) or less. subject to the provision that the original conwct price may not be increased by more than twenq-five percent (25%) or decreased by more than twenty- five percent [25%] without the consent of the conkactor to such decrease.
