ORDINANCE NO. 10,382
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, SETTING A DATE AND PLACE FOR A PUBLIC HEARING ON
THE PROPOSED INITIATIVE ORDINANCE WHICH PROHIBITS SMOKING
WITHIN THE CITY OF BAYTOWN IN ALL ENCLOSED PUBLIC PLACES
AND PLACES OF EMPLOYMENT AND WITHIN 15 FEET OF THEIR
ENTRANCES AND WHICH PROHIBITS SMOKING IN THE SEATING
AREAS OF ALL OUTDOOR ARENAS, STADIUMS AND
AMPHITHEATERS; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
WHEREAS, on July 21. 2006, an initiative petition, proposing to prohibit smoking within
the City of Baytown in all enclosed public places and places of employment and within 15 feet
of their entrances and proposing to prohibit smoking in the seating areas of all outdoor arenas.
stadiums and amphitheaters, was filed with the City Clerk; and
WHEREAS, upon receipt of such petition, the City Clerk in accordance with Section 100
of the Charter of the City of Baytown, Texas, reviewed each petition paper to determine whether
each had a proper statement of the circulator and whether the petition was signed by a sufficient
number of qualified electors; and
WHEREAS, the City Clerk issued a certificate of sufficiency and tendered the same to
the City Council on August 10, 2006, which was the first regular meeting of the City Council
after the City Clerk completed her examination of the petition; and
WHEREAS, upon receiving the certification of sufficiency concerning the initiative
petition from the City Clerk , the City Council is required to provide for a public hearing on the
proposed initiative ordinance; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That all matters and facts set forth in the recitals hereinabove are found to
be true and are approved by the City Council of the City of Baytown, Texas.
Section 2: At its regularly scheduled meeting on the 24"' day of August, 2006, which
commences at 6:30 p.m., in the Council Chambers of the City Hall of the City of Baytown,
located at 2401 Market Street, Baytown, Texas, the City Council will hold a public hearing
giving all interested parties the right to appear and be heard on the proposed initiative ordinance
which prohibits smoking within the City of Baytown in all enclosed public places and places of
employment and within 15 feet of their entrances and which prohibits smoking in the seating
areas of all outdoor arenas, stadiums and amphitheaters.
Section 3: The City Clerk of the City of Baytown is hereby authorized and directed
to cause notice of such public hearing to be published once in the newspaper having general
