Ordinance No. 10,350 ORDINANCE NO. 10,350 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF BAYTOWN CONCERNING PROPERTY DESCRIBED AS TRACTS SC AND 15 OUT OF THE J.W. SINGLETON SURVEY, A-709, BAYTOWN, HARRIS COUNTY, TEXAS TO RECLASSIFY A PORTION OF SUCH PROPERTY FROM A NEIGI-IBORHOOD CONSERVATION DISTRICT TO A MIXED USE DISTRICT: AND PROVIDING FOR THE EFFECTIVE DATE THEREOF- ****,**-V-****�4c**** lc*�� x�����x �� x���x �������� u����������x �������������x ���� WHEREAS, an application to amend the official zoning map was proposed by the owner of the property affected by the proposed amendment to rezone Tracts SC and 15 out of the J.W. Singleton Survey. A-709. Baytown, Harris County. Texas from a Neighborhood Conservation District to a Mixed Use District: and WHEREAS, upon receipt of the completed application, the Director of Planning and Development Services prepared a staff report, which included a recommendation for the approval of a portion of the proposed amendment to the official zoning map based upon the criteria specified in Section 130-163 of the Code of Ordinances, Baytown, Texas (the `'Code"); and WHEREAS, on May 17, 2006, the Zoning Commission, after due notice as required in Section 130-121 of the Code, held a public hearing to consider the application, the staff report, the relevant support materials and public testimony given at the public hearing: and WHEREAS, after the public hearing, the Zoning Commission prepared and delivered a report and a recommendation to the City Council to approve a portion of the proposed amendment based upon the criteria specified in Section 130-163 of the Code: and WHEREAS, on June 22. 2006. the City Council, after due notice as required in Section 130-121 of the Code, held a public hearing on the proposed amendment to consider the application, the staff report, the relevant support materials, the recommendation of the Zoning Commission, and the public testimony given at the public hearing: and WHEREAS, based on the information and recommendations received, the City Council hereby finds that each of the criteria specified in Section 130-163 of the Code has been satisfied and. therefore, desires to amend the zoning map only to the extent indicated hereinbelow: NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1. That the City Council of the City of Baytown, Texas, hereby amends the official zoning map of the City of Baytown to effectuate a zoning district change for a portion of the property described as Tracts 8C and 15 out of the J.W. Singleton Survey, A-709, Baytown, Harris County, Texas, that being approximately 160 feet of the southern portion of the property as it lines up with the rear property line of the adjacent commercial property to the west, from a Neighborhood Conservation District to a Mixed Use District. The amended portion of the official zoning map is attached hereto as Exhibit "A" and incorporated herein for all intents and purposes. Section 2: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
