AN ORDINANCE OF THE CiTY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
RENEWING TFIE CONTRACT OF WASTE MANAGEMENT OF TEXAS FOR THE
ANNUAL RECYCLING CENTER CONTRACT AND AUTHOREWG PAYMENT BY
THE CITY OF BAYTOWN, THE SUM OF SIXTY-EIGHTTAOUSAND SIXFKNDRED
EIGHTY-THREE AND 3211 00 DOLLARS ($68,683.32); MAKING O~PROVISIONS
RELATED TEERETO; AND PROVIDING FOR THE EFFEm DATE THEREOF.
WEEREAS, Waste Management of Texas was awarded the Annml Recycling Center Contract on
June 23,2005, purmant to competitive bidding procdms, which contract included an aption by the parties to
renew for additional one-year periods; and
WHEREAS, Waste Management of Texas has indicated its willingness to renew the contract for an
additional under the same terrras and conditions; and

BE l'T ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby renews the con $ad of Waste
Management of Texas for the Annd Recycling Center Contract forthe sum of SIXTY-EIGHT THOUSAND
SIX HUNDRED EZGHTY-THREE AND 3211 00 DOW ($68,683.32), and authorim pagnent &emf.

Section 2: That pursuant to the provisions of Texas Local GOY-t ~obe Annotated
3252.0148, the City Manager is hereby $ranted general authority to approve any change order involving a
decrease or an increase in costs of TWENlY-FIVE THOUSAND AND N0/100 DOLIARS ($25,000.00) or
less, provided that the ori@ contract price may not be inmad by more than twenty--five percent (25%) or
decreased by more h twenty-five percent (25%) without the consent of the contractor to such demase.
Section 3: This ordinance shall take effect immediately from and after its passage by the City
Council of the City ofBaytown.
