AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY
LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF
16.1545 ACRES OF LAND IN THE NATHANIEL LYNCH SURVEY, A -44,
HARRIS COUNTY, TEXAS; WHICH SAID TERRITORIES LIE ADJACENT TO
AND ADJOIN THE PRESENT BOUNDARY LIMITS FOR THE CITY OF
BAYTOWN, TEXAS.
WHEREAS, there being no request for an "on- site" hearing, two public hearings before the
City Council of the City of Baytown, Texas, where ali interested persons were provided with an
opportunity to be heard on the proposed annexation of the property described in Section 1 of this
ordinance, were held, during the City Council meeting on the 13`h day of April, 2006, in the City
Council Chamber of the City Hall of the City of Baytown, Texas, which date is not more than forty
(40) nor less than twenty (20) days prior to the institution of annexation proceedings; and

WHEREAS, a notice of such public hearings was posted on the City of Baytown's website on
the 31" day of March, 2005, which date is not more than twenty (20) nor less than ten (10) days prior
to the date of such public hearings and remained posted until the date of the hearings; and
WHEREAS, the total corporate area of the City of Baytown, Texas, on the 1 st day of January,
2006, was 34.0 square miles; and
WHEREAS, the population of the City of Baytown, Texas, is approximately 71,359
inhabitants: and
WHEREAS, the below described territories lie within the extraterritorial jurisdiction of the
City of Baytown, Texas; and
WHEREAS, the below described territories lie adjacent to and adjoin the City of Baytown,
Texas; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the following described land and territories lying adjacent to and
adjoining the City of Baytown are hereby added and annexed to the City of Baytown, Texas, and
shall hereinafter be included within the boundary limits of the City of Baytown, Texas, and present
boundary limits of such City, at the various points contiguous to the areas hereinafter described, are
altered and amended so as to include said areas within the corporate limits of the City of Baytown,
Texas, to -wit:

Section 2: The above described territories and the areas so annexed shall be a pall of tile
City of Baytown, Texas, and the property so added hereby shal I bear its pro rata of the taxes levied
by the City of Baytown, Texas, and the inhabitants thereof shall be entitled to all of the rights and
privileges of all the citizens of the City of Baytown and shall be bound by the acts, ordinances,
resolutions, and regulations of the City of Baytown, Texas.
Section 3: In accordance with Texas Local Govemi-nent Code: Annotated § 43.056, as
amended, the service plan prepared by the City for providing municipal services to the annexed areas
is attached as Exhibit "B" and is hereby approved.
Section 4: This ordinance shall be published and passed in the manner provided in
Article 1, Section 9, of the Charter of the Cit-, y of Bay ow�i,, Texas.

The area being annexed is described as a 16.1545 acre tract of land out of the
Nathaniel Lynch Survey, Abstract No. 44, Harris County, Texas, and more
particularly described in the attached metes and bounds.
Size of Area: The proposed area for annexation is 16.1545 acres shown on the
attached map.
Proposed Land Use: Residential. Upon annexation, the property will be in the
Mixed Use (MU) zoning district.
Impact: As a result of this proposed annexation:
The Fire Department's delivery performance measure based on the existing
resources for the Response Time from receipt of call for services until the arrival
of the 1st due company will be 5 minutes 36 seconds (1.8miles). The time of less
than six minutes is required to confine fire to the room of origin and increase the
probability of accomplishing the critical task of rescue, fire control, and property
conservation. EMS survivability from cardiac arrest increase by 10% for each
minute with BLS care before 6 minutes. Response Time from receipt of call for
services until the arrival of the first alarm assignment (2 Engines, 1 Ladder, 1
Chief) on location will be 17 minutes 24 seconds (7.7 miles). The time over 10
minutes will significantly increase fire spread and therefore decrease rescue, fire
control, and property conservation measures. Additionally, the return of
circulation for cardiac arrest victims diminishes significantly without ALS care
within 10 minutes. To improve the service delivery performance measures for the
proposed area would incur an initial investment of $1,989,0010, for the
construction of a new building, equipment and personnel, and a recurring cost of
$895,313. The project site will be assigned to Fire Station 5. (See attached
Service Plan).
The Police Department's indicates that preventive patrol time will decrease with
additional workload; and an increase in population will increase crime rate and
response time to current residents. Additional manpower is expected. The
project site will be assigned to Police District 1. (See attached Service Plan).,
All Annexations increase Public Works / Utilities response time, workloads and
work order backlogs on a cumulative basis. (See attached Service Plan).
The Health, Department states that future annexation and development will
increase the demand, for services and decrease our ability to meet Advance Life
Support (ALS) response standards. To improve the service delivery performance

This is our response to the proposed annexation of 16.1545 acres (in additional to the previously
proposed annexation of 403.9469 acres in the same area) located in the Nathaniel Lynch Survey,
located south cast of I -10 and Decker Drive for use as a residential apartment complex.
The decision to add or modify Emergency Medical Service resources are based on two primary
criteria- Call Volume and Response Times.
Call Volume
The requests for service that we receive vary by time of day, day of week. Our goal is to
maintain enough ambulances so that we are able to respond to every request for service, allowing
for hourly call volume: fluctuations. Historically, each City EMS unit can handle an average of
2,400 requests for service each year without significantly impacting our ability to respond to
each call. Our failure to maintain adequate resources results in calls which are passed to
commercial ambulance firms, which do not maintain the same standards of care which we offer
to the citizens. We have 3 EMS units staffed each day, which gives us a call load limit of about
7,200 requests for service. Our call volume this year has exceeded 7,200 and we are forecasting
an increase to just over 7,500 for next year.
New development impacts our call volume. As an example, a growth in population of 120
individuals adds I call per month to our call volume. In this specific annexation request, there's
no specific estimate of the residential impact for this area. The potential growth may not be the
`trigger' to require additional response resources, but other cumulative incremental growth in
Baytown may push anticipated call volume further beyond 7,200 requests annually. This will
require the consideration of additional staffed ambulances to meet call volume demands.
Response Times
There are several sources for response time standards for Emergency Medical Services. The two
most noted are the National Fire Protection Association (NFPA) Standard 1710, and the U.S.
Department of Health and Human Services, National Institutes of Health, National Heart, Lung
Health Depar-ti-►ent

and Blood Institute "Staffing and Equipping Emergency Medical Services Systems ". They both
state that Advanced Life Support (ALS) response should be 9 minutes or less, 90% of the time.
Using current staffing and deployment plans, response time computer modeling and historical
data, the area considered for annexation will be within the minimum ALS response time
standards.
Recommendation
Future annexation and development will not only increase the demand for services, but will also
decrease our ability to meet ALS response standards.
Estimated Costs
Buildings — Construction of a facility to house an ALS ambulance and crew 24 hours per
day in the northwest section of Baytown. Approximate Cost $750,000.
Vehicles — One Type 1, Class lA Modular Ambulance. Approximate Cost $130,000.
Additional Personnel — Four (4) Paramedics, Three (3) Senior Paramedics to staff the
ambulance. Approximate Cost $350,000.
Capital Equipment — Minimum essential equipment for the new ambulance, to include
12 -lead EKG Monitor, Stretcher, Carry -in Bags, Extrication Equipment, 2 -way radios for
ambulance, portable radios for crew. Approximate Cost $45,000
