AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, AMENDING CHAPTER 2
"ADMINISTRATION," ARTICLE IV "BOARDS AND
COMMISSIONS" OF THE CODE OF ORDINANCES, BAYTOWN,
TEXAS, BY ADDING A NEW DIVISION TO BE NUMBERED AND
ENTITLED DIVISION 13 "BAYTOWN REDEVELOPMENT
ADVISORY TASK FORCE" TO ESTABLISH SUCH TASK FORCE,
PROVIDE FOR ITS MEMBERSHIP ALONG WITH ITS POWERS
AND DUTIES; PROVIDING A REPEALING CLAUSE; CONTAINING
A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That Chapter 2 "Administration," Article IV "Boards and
Commissions," of the Code of Ordinances, Baytown, Texas, is hereby amended by
adding a new division to be numbered and entitled Division 13 "Baytown Redevelopment
Advisory Task Force," which shall read as follows:
CHAPTER 2. ADMINISTRATION
ARTICLE IV. BOARDS AND COMMISSIONS
DIVISION 13. BAYTOWN REDEVELOPMENT ADVISORY TASK FORCE
Sec. 2 -561. Created; membership.
There is created a eleven- member advisory task force which shall assist and
advise the city council on the proper operation of redevelopment and revitalization efforts
within the city. The task force shall be known as the Baytown Redevelopment Advisory
Task Force and shall have no quasi - judicial or rule- making authority.
Sec. 2 -562. Appointments, terms.
(a) The Baytown Redevelopment Advisory Task Force shall consist of eleven
members. The following shall each appoint one of its directors to the task force:
(1) Baytown Area/West Chambers County Economic Development
Foundation,
(2) Baytown Chamber of Commerce,

® (3) Hispanic Chamber of Commerce of Greater Baytown, and
(4) Baytown Downtown Association, Inc.

The following shall each appoint one of its members to the task force:
(1) Baytown Municipal Development District,
(2) Planning and Zoning Commission,
(3) Baytown Redevelopment Authority,
(4) Baytown Beautification Advisory Commission,
(5) Community Development Advisory Commission,
(6) Mayor, and
(7) City Manager.
All persons appointed to the task force are subject to approval of the city council.
Elected governmental officials shall not be eligible to serve. The members of the
task force shall serve at the pleasure of the city council and may be removed by
the city council with or without cause.
(b) The terms of persons appointed as members of the task force shall be as follows:
(1) the terms of the persons appointed by the following shall be equal to their
tenures as directors of the entities from which they were appointed or two
years, whichever is shorter:
a. Baytown Area/West Chambers County Economic Development
Foundation,
b. Baytown Chamber of Commerce,
C. Hispanic Chamber of Commerce of Greater Baytown, and
d. Baytown Downtown Association, Inc.; and
(2) the term of the persons appointed by the following shall be equal to their
tenures as members of the districts, commissions or authorities from
which they were appointed or two years, whichever is shorter:
a. Baytown Municipal Development District,

C. Baytown Redevelopment Authority,

d. Baytown Beautification Advisory Commission, and
e. Community Development Advisory Commission.
(3) Members shall serve until their successors have been appointed.
Sec. 2 -563. Rules of procedure.
(a) The Baytown Redevelopment Advisory Task Force shall establish its own rules
and procedures, provided that such shall not be in conflict with this division, the
charter or other provisions of law.
(b) A quorum shall consist of the majority of the entire membership of the task force
and an affirmative vote of the majority of those present shall be necessary to pass
upon pending questions. The chairperson shall be entitled to vote upon any
question, but shall have no veto power.
(c) Meetings shall be open to the public and shall be held at least four times per year
at the call of the chairperson and at other times as determined by the task force.
(d) The task force shall keep minutes of its meetings that indicate the vote of each
member on each question or the fact that a member is absent or fails to vote. The
task force shall keep records of its official actions. The minutes and records shall
be filed in the planning and development services department's office and are
public records.
Sec. 2 -564. Officers.
(a) On or before August 1 of each year, the city council shall select the task force's
chairperson and vice - chairperson from the members of the task force.
(b) The vice - chairperson shall assist the chairperson in directing the affairs of the task
force. In the absence of the chairperson, the vice - chairperson shall assume the
duties of the chairperson. The vice - chairperson, when acting as chairperson, shall
retain the right to vote.
(c) In the event of the absence of both the chairperson and. vice - chairperson, any
member of the task force may be selected as the acting chairperson for that
particular meeting by majority vote of the members present. Any task force

® member acting as chairperson shall retain the right to vote. No member shall be
required to act as chairperson if the member so declines.

See. 2 -565. Attendance at meetings.
Any member of the Baytown Redevelopment Advisory Task Force who misses
three consecutive regular meetings without valid reason may be deemed no longer
interested in serving, and the task force may ask the city council to remove the task force
member and appoint a person to fill the remaining term of such member.
Sec. 2 -566. Duties; reports.
(a) The duties of Baytown Redevelopment Advisory Task Force shall be to advise the
city council on redevelopment and revitalization efforts within the city. The task
force shall initially focus on the areas of Texas Avenue, Market Street, and
Alexander Drive, while being open to considering other economically challenged
areas. The task force shall work with the staffs of the city, the chambers of
commerce, and the economic development foundation, together with existing city
boards and commissions and redevelopment advocacy groups to:
(1) Review areas in need of improving, upgrading and revitalizing within the
city that have become blighted because of deterioration, disuse, or
unproductive economical conditions;
(2) Study and propose effective mechanisms to foster economic development
and revitalization within both new construction and the preservation and
restoration of existing structures;
(3) Utilize existing plans and studies (i.e., comprehensive plans, downtown
master plans, marketing studies, etc.) in formulating recommendations to
the city council;
(4) Analyze available existing and potential financial incentive programs,
evaluate the cost benefit of said programs and recommend those deemed
appropriate for economic development projects including those where
blight, environmental considerations or functional obsolescence create an
impediment to redevelopment of property;
(5) Review available grant programs, evaluate local matching requirements, if
any, and recommend submittal of applications; and
(6) Make an annual report to the city council on or before July 1" of each
year.

® (b) The Baytown Redevelopment Advisory Task Force is further authorized to work
with the city manager and make recommendations to the city manager about any
matter that it deems beneficial to the administration, provided that such functions
shall be consistent with its duties enumerated in this section and do not
contravene with the Charter or any other law. The task force's recommendations
shall be considered advisory only.

(c) The Baytown Redevelopment Advisory Task Force shall perform such functions
as may be duly delegated to it from time to time by the city council.
Sec. 2 -567. Subcommittees.
To exercise the powers and accomplish the duties of the Baytown Redevelopment
Advisory Task Force, the task force may establish subcommittees. Each subcommittee
shall be chaired by a task force member with an unspecified number of community
volunteers chosen by the task force as working subcommittee staff.
Sec. 2 -568. Donations.
All ' donations received in support of the Baytown Redevelopment Program shall
be deposited into the city's treasury with a separate general ledger account set up to
reflect the receipts and disbursements. All expenditures shall be made in accordance with
the city's purchasing policies and procedures.
Section 2: All ordinances or parts of ordinances inconsistent with the terms of
this ordinance are hereby repealed; provided, however, that such repeal shall be only to
the extent of such inconsistency and in all other respects this ordinance shall be
cumulative of other ordinances regulating and governing the subject matter covered by
this ordinance.
Section 3: If any provision, section, exception, subsection, paragraph,
sentence, clause or phrase of this ordinance or the application of same to any person or
the set of circumstances, shall for any reason be held unconstitutional, void or invalid,
such invalidity shall not affect the validity of the remaining provisions of this ordinance
or their application to other persons or sets of circumstances and to this end all provisions
of this ordinance are declared to be severable.
Section 4: This ordinance shall take effect Miriiediately from and after its
passage by the City Council of the City of Baytown. .
