AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
GIVING EFFECT TO A PORTION OF THE LETTER FROM THE FORMER CITY
MANAGER CONCERNING CONNECTION FEES (NOW IMPACT FEES) FOR
CERTAIN TRACTS OF LAND OWNED BY NORMAN DYKES AND THE
ACQUISITION OF A 0.0367 ACRE TRACT OF LAND FOR A LIFT STATION; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby gives effect to the
following statement in the letter dated December 18, 1995, from the former city manager to Norman
Dykes concerning certain property he owned:
The City of Baytown agrees that there will be no charge to you or your successors for
water and sewer connections to existing or new city lines which may be adjacent to the
property described in Exhibit `B."
By giving effect to such statement, it is declared that the impact fees for property described hereinabove
have been prepaid as part of the City's 1995 purchase of a 0.0367 acre tract of land for a lift station. A
copy of the letter is attached hereto as Exhibit "A," and made a part hereof for all intents and purposes.
Section 2: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of
Baytown this the 23r4 day of March, 2006.

Re: Lift station site located at the Landing at Cedar Bayou
Dear Norman:
Enclosed please find the following documents:
(1) A copy of Ordinance No. 7582, passed by the City Council of the City of Baytown on
December 14, 1995, authorizing the execution of the documents hereinbelow listed and the
expenditure of funds;
(2) City of Baytown check no. 166582 in the amount of $50,000.00 as payment in full. This
payment is for the purchase of the lift station site amounting to THREE THOUSAND TWO
HUNDRED SIXTY AND N01100 DOLLARS ($3,260.00) and damages arising from its
placement amounting to FORTY -SIX THOUSAND SEVEN HUNDRED FORTY AND
NO 1100 DOLLARS ($46,740.00);
(3) An original Deed, dated December 15, 1995, granting the two previous easements back to
you;
(4) A copy of the appraisal;
(5) An original Warranty Deed for the purchase of property for the lift station site; and
(6) Form W -9 "Request for Taxpayer Identification Number and Certification.'
The above- referenced documents address Item Nos. I and 4 in your letter of December 7, 1995, a copy of
which is attached hereto as Exhibit "A."
Regarding Item No. 2 in your letter, the City of Baytown agrees that there will be no charg-e to you
or your successors for water and sewer connections to existing or new city lines which may be adjacent to
the property described in Exhibit "B." Lastly, in reference to Item No. 3, a chain link fence will be installed
and landscaping- around the fence will be done as on previous sites. Any future changes in the fencing will
be at your expense and must meet TNRCC guidelines and the city's safety requirements.

Dear Bobby,
As you know my preference is that the lift station be located at the rear of the
property not at the front corner. In order for the city to leave the lift station at
its present location I would require the following:
Give deed on previous two sewer easement sites back to
me.
2. No charge to me or my successors for water and sewer
connection fees for connecting to the existing old or new
water and sewer lines adjacent to my property (both tracts).
3. Fence surrounding lift station shall be to my specifications
with right to change the fence in the future. Any future
changes shall be at my expense. City shall also landscape
around the fence as has been done on previous sites.
4. Cost for new lift station site and damages incurred to
remaining property shall be $50,000.
