AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER •
AND THE CITY CLERK OF THE CITY OF BAYTOWN TO EXECUTE AND
ATTEST TO A CONTRACT AMENDMENT WITH TEXAS DEPARTMENT OF •
TRANSPORTATION FOR SUPPLEMENTAL FUNDING FOR PHASE III OF
THE GOOSE CREEK STREAM GREENBELT TRAIL;AUTHORIZING A CASH
MATCH FOR THE CONGESTION MITIGATION AND AIR. QUALITY
SUPPLEMENTAL FUNDING IN THE AMOUNT OF FIFTY THOUSAND AND "
NO/100 DOLLARS ($50,000.00); AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1: That the City Council of the City of Baytown,Texas,hereby authorizes and
directs the City Manager and the City Clerk of the City of Baytown to execute and attest to..a
contract amendment with Texas Department of Transportation for supplemental funding for Phase
III of the Goose Creek Stream Greenbelt Trail. A copy of said amendment is attached hereto,
marked Exhibit "A," and made a part hereof for all,intents and purposes.
Section 2: That for the supplemental Congestion Mitigation and Air Quality funds to be
received for the Phase III of the Goose Creek Stream Greenbelt Trail Project,the City Council of the
City of Baytown authorizes a cash match not to exceed FIFTY THOUSAND AND NO/100
DOLLARS ($50,000.00).
Section 3: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.

AMENDMENT THREE TO THE AGREEMENT
(TRANSPORTATION ENHANCEMENT AND CONGESTION
MITIGATION AND AIR QUALITY PROGRAMS)
THIS AMENDMENT IS MADE BY AND BETWEEN the State of Texas, acting through
the Texas Department of Transportation hereinafter called the "State ", and the City of
Baytown, Texas, hereinafter called the "City.
WITNESSETH
WHEREAS, the State and the City executed an agreement on the 15th day of February
1995 concerning the construction of a multipurpose bicycle /pedestrian facility with
landscaping and historic preservation from SH 146 to Decker Drive along Goose Creek
in Baytown; and
WHEREAS, the State and the City executed Amendment One to the agreement on the
31St day of March 2000 which added supplemental Congestion Mitigation and Air
Quality (CMAQ) funds to the original enhancement funds; and
WHEREAS, the State and the City executed Amendment Two to the agreement,
increasing Federal funds available for the project on the 5th day of January 2004; and
WHEREAS, on the 27`h day of January 2006 the Metropolitan Planning Organization
passed Amendment 70 to the Transportation Improvement Program, which is attached
to this Amendment as "Exhibit I" providing additional funds to the project; and
WHEREAS, it has become necessary to amend that contract;

A'' NOW THEREFORE, in consideration of the premises and of the mutual covenants and
agreements of the parties hereto, the State and the Local Government do agree as
follows:
AGREEMENT
Article 1. Description of Amended Items
Paragraphs A and B of Section 5 of the Agreement are voided in their entirety
and replaced with the following:
A. The estimated total cost of all phases of the Project, including construction
engineering and testing services, is $2,810,750. Congestion Mitigation and
Air Quality funding will total $1,406,250 and Enhancement funding will total
$1,404,500.
B. The State will be responsible to secure the federal share of funding required
for the development and construction of all phases of the Project. The
federal share for the development and construction of all phases of the
Project is eighty percent (80 %) of the total estimated cost of all phases of the
Project, not to exceed $2,248,600. The Federal portion of the Congestion
Mitigation and Air Quality funding will total $1,125,000 and Enhancement
funding will total $1,123,600. The City will be responsible to comply with the
cost principles established in OMB Circular A -87, "Cost Principles for State
and Local Governments" and for any non - federal participation costs
associated with all phases of the Project.
2. The 2006 -2008 Transportation Improvement Program Amendment Number 70 is
attached to Amendment Three and labeled "Exhibit I ".
All other provisions of the original contract are unchanged and remain in full force and
effect.
Article 2. Signatory Warranty
The signatories to this amendment warrant that each has the authority to enter into this
agreement on behalf of the organization they represent.

0912 -31 -143 is on page 2 -11 of the 2006 -2008 Transportation Improvement Program (TIP); project
CSJ 0912 -31 -143 was amended via Amendment T37 in October 2005. All three projects are funded
with Category 5 Clv1AQ funds.
Project CSJ 091'2-31 -143 has been rescheduled for letting in February 2006. The project is intended to
helt) fulfill the TCM. SIP commitment in the new conformity plan. On January 10, 2006 the City of
Lake Jackson requested additional funds for the project due to the fact that the price of concrete is still
rising and the current allocation for the Oyster Creek Bikeway is expected to prove insufficient.
Project CSJ 0912 -71 -698 let in September 2004 and is about 70% complete. However, the cost of
supplies, fuel, and some complications and changes have caused the project to exceed its budget.
There have been site conditions discovered during construction and railroad issues at heir crossings
that have required several large change orders. Therefore, the City of Baytown has requested that
project CSJ 09122-71 -698 be provided with additional funds in the amount of 5250.000.
Project CSJ 0 1.71- 05 -0 23 let in Septembe- 2005 for less than the authorized amount of 51.931.850.
Therefore, at this time, TxDOT is requesting to transfer funds from CSJ 0271- 05 -0 ^3 to CSJ 0912 -71-
698 and CSJ 0912 -31 -143.

698 and CSJ 0912-31-143.
