ORDINANCE NO. 10,237 and January 19, 2006
• AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, ADDING A 0.323 ACRE TRACT SITUATED IN THE ED T. SCHAFFER
SURVEY, ABSTRACT 1224, HARRIS COUNTY, TEXAS, AND BEING OUT OF
A PART OF LOT 12 AND THE WEST %z OF LOT 13, BLOCK 1 OF THE EAST
END ADDITION TO HIGHLAND FARMS SUBDIVISION AND ALSO BEING
OUT OF AND A PART OF THAT CERTAIN 0.838 OF AN ACRE TRACT
HERETOFORE SURVEYED OUT OF LOTS 10, 11, 12 AND 13, BLOCK I OF
SAID EAST END ADDITION TO HIGHLAND FARMS SUBDIVISION TO
COUNCIL DISTRICT NO. 4; REPEALING ORDINANCES INCONSISTENT
HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR
THE PUBLICATION AND EFFECTIVE DATE THEREOF.
WHEREAS, Section 17(1) of the Charter of the City of Baytown provides that the City
Council shall redistrict the City if the growth of the City justifies; and
WHEREAS, it is necessary to include the newly annexed territory described herein in a
Council District; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: Council District No. 4 is hereby redistricted by the addition of certain
property which is described on the attached Exhibit "A."
Section 2: All ordinances or parts of ordinances inconsistent with the terms of this
ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such
inconsistency and in all other respects this ordinance shall be cumulative of other ordinances
regulating and governing the subject matter covered by this ordinance.
Section 3: If any provisions, section, exception, subsection, paragraph, sentence, clause
or phrase of this ordinance or the application of same to any person or set of circumstances, shall for
any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validityof the
remaining provisions of this ordinance or their application to other persons or sets of circumstances
and to this end all provisions of this ordinance are declared to be severable.
Section 4: This ordinance shall take effect from and after ten (10) days from its passage
by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption
of this ordinance to be published in the official newspaper of the City of Baytown at least twice
within ten (10) days after passage of this ordinance.

FIELD NOTES of a 0.323 of an acre tract (14,086.6334 square feet) situated in the Ed T.
Schaffer Survey (W. C. R. R.) Abstract 1224, Harris County, Texas, and being out of and
a part of Lot 12 and the West 1/2 of Lot 13, Block 1 of the East End Addition to Highland
Farms Subdivision; map of which is of record in Volume 15 at Page 60 of the Map
Records of Harris County, Texas. Said 0.323 of an acre also being out of and a part of
that certain 0.838 of an acre tract heretofore surveyed out of Lots 10, 11, 12 and 13,
Block 1 of said East End Addition to Highland Farms Subdivision. This 0.323 of an acre
tract of land is more particularly described by the following metes and bounds, to -wit:

MONUMENTS IN THE SOUTH LINE OF THAT CERTAIN 0.178 OF AN ACRE
TRACT OF LAND DESCRIBED IN RIGHT -OF -WAY DEED DATED FEBRUARY
22, 1978 FROM LEVI W. KELLY, ET UX, TO THE COUNTY OF HARRIS AND
RECORDED UNDER COUNTY CLERK'S FILE NO. F539195 OF THE OFFICIAL
PUBLIC RECORDS OF REAL PROPERTY OF HARRIS COUNTY, TEXAS.
BEGINNING at a % inch iron rod in the North right -of -way line of North Road (60 feet
wide right -of -way) at the Southeast corner of the West % of said Lot 13 and the
Southwest corner of the East' /2 of said Lot 13. Said point being the Southeast corner of
said 0.838 of an acre and being the Southeast corner and POINT OF BEGINNING of this
tract.
THENCE: South 79'20'19" West along the South line of this tract, the South line of said
0.838 of an acre, the South line of said Lot 13 and Lot 12 and the North right -of -way line
of North Road for a distance of 143.77 feet to a point for the Southwest corner of this
tract. Said point being in the existing corporate limits of the City of Baytown, Texas
(based on said corporate limits being 300 feet East of and parallel with the centerline of
Garth Road). Said point being in a curve, concave Easterly.
THENCE: Along and around said curve to the right, in a Northerly direction, along the
West line of this tract and along the existing corporate limits of said City of Baytown,
Texas, said curve having a radius of 1699.22 feet, an arc length of 69.63 feet and a chord
bearing and distance of North 06 °38'44" West 69.62 feet, over and across a portion of
said 0.838 of an acre, to a point for the TERMINATION POINT of said curve.
THENCE: North 05 °29'09" West along the West line of this tract and the existing
corporate limits of said City of Baytown, Texas, over and across a portion of said 0.838
of an acre, for a distance of 30.67 feet to a point in the North line of said 0.838 of an acre
for the Northwest corner of this tract.

THENCE: North 79'20'19" East along the North line of this tract and the North line of
said 0.838 of an acre for a distance of 137.21 feet to a % inch iron rod, with cap, for the
Northeast corner of said 0.838 of an acre and the Northeast corner of this tract in the East
line of the West %2 of said Lot 13 and the West line of the East % of said Lot 13.
THENCE: South 10'02'10" East along the East line of this tract, the East line of said
0.838 of an acre, the East line of said West % of said Lot 13 and the West line of said
East % of said Lot 13, for a distance of 100.00 feet to the PLACE OF BEGINNING and
containing within these boundaries 0.323 of an acre of land (14,086.6334 square feet).
