ORDINANCE NO. 10,236 January 19, 2006
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
•ADDING 0.0295 ACRES OF LAND IN THE ED SHAFFER SURVEY, ABSTRACT NO.
4 1224, AND THE T.T. RISTERGEN SURVEY, ABSTRACT NO. 1425, HARRIS
COUNTY, TEXAS, TO COUNCIL DISTRICT NO. 3; REPEALING ORDINANCES
INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING
FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF.
WHEREAS, Section 17(1) of the Charter of the City of Baytown provides that the City Council shall
redistrict the City if the growth of the City justifies; and
WHEREAS, it is necessary to include the newly annexed territory described herein in a Council
District; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: Council District No. 3 is hereby redistricted by the addition of certain property which
is described on the attached Exhibit "A."
Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are
hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all
other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject
matter covered by this ordinance.
Section 3: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase
of this ordinance or the application of same to any person or set of circumstances, shal I for any reason be held
unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this
ordinance or their application to other persons or sets of circumstances and to this end all provisions of this
ordinance are declared to be severable.
Section 4: This ordinance shall take effect from and after ten (10) days from its passage by the
City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance
to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after
passage of this ordinance.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of

property described by metes and bounds as follows:
Description of 0.0295 acre (1,285 square feet) of land out of Lot 2 of The Minor Plat of
Scottish Inns and Suites as recorded in Film Code No. 519052 of the Harris County Map
Records, located in the Ed Schaffer Survey, Abstract No. 1224, and the T. T. Ristergen
Survey, Abstract No. 1425, in the City of Baytown, Harris County, Texas and being more
fully described by metes and bounds as follows (with bearings referenced to the west
right -of -way line of Garth Road as shown on The Minor Plat of Scottish Inns and Suites):
COMMENCING at a 1/2 -inch iron rod found in the west right -of -way line of Garth Road
(120 -feet wide) marking the common southeast corner of Lot 1 of said Minor Plat of
Scottish Inns and Suites and the northeast corner of said Lot 2 and the herein described
tract;
THENCE, South 790 21' 20" West, along the common line between said Lots 1 and 2, a
distance of 240.02 feet to the POINT OF BEGINNING of the herein described tract;
THENCE, South 090 50' 36" East, along a line located 300 -feet westerly of and parallel
with the centerline of said Garth Road, .a distance of 164.99 feet to a point for comer in
the common south line of said Lot 2 and a north line of a called 4.00 acre tract described
in a Warranty Deed to W. P. E. Inc. recorded as Hams County Clerk's File R051109;
THENCE, South 79° 21' 20" West, along the south line of said Lot 2 and a north line of
said W. P. E. Inc. tract, a distance of 7.79 feet to a 1/2 -inch iron rod found for the
southwest corner of said Lot 2 and an interior corner of said W. P. E. Inc. tract;
THENCE, North 090 50' 36" West, along the west line of said Lot 2 and an east line of
said W. P. E. Inc. tract, a distance of 164.99 feet to a 1/2 -inch iron rod found for the
common southwest comer of the aforesaid Lot 1 and the northwest corner of said Lot 2 of
The Minor Plat of Scottish Inns and Suites;
THENCE, North 79° 21' 20" East, along the common line between said Lots l and 2, a
distance of 7.79 feet to the POINT OF BEGINNING and containing a computed area of
0.0295 acre (1,285 square feet) of land. This description is compiled from a ground
survey made by Jesse R. Petty, Registered Professional Land Surveyor, on September 29,
