Ordinance No. 10,201ORDINANCE NO. 10,201 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, CALLING FOR THE CLOSING OF THE RAILROAD CROSSINGS LOCATED ON CARNEGIE STREET AND ON W. PEARCE AVENUE IN THE CITY OF BAYTOWN, TEXAS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the Union Pacific Railroad Company, the Texas Department of Transportation, and the City of Baytown, Texas, have joined together to consolidate redundant and unnecessary street/railroad crossings; and WHEREAS, because each grade crossing represents elevated risk as an additional opportunity for a collision between a train and a vehicle, the City staff met with public safety officials, the Goose Creek Independent School District and Lee College to determine if there were any of the redundant grade crossings that could be closed to improve safety while not posing operational or public safety obstacles; and WHEREAS, of the various possible locations that were discussed at such meetings, two were identified as candidates for closure: Carnegie Street and W. Pearce Avenue, for each is located adjacent to another crossing and has low traffic counts; and WHEREAS, the City Council of the City of Baytown, Texas, believes that for the public health, safety and welfare, the railroad crossings at Carnegie Street and W. Pearce Avenue should be permanently closed to vehicular traffic and vacated; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section I: The facts recited in the preamble of this Ordinance are hereby found and declared to be true and correct. Section 2: That the Carnegie Street crossing (DOT 762 842B) be permanently closed to vehicular traffic and vacated at the time the City places the appropriate barricades or end - treatment on both of the roadway approaches of each crossing at a distance of about 50 feet from the Main Track, Section 3: That the W. Pearce Avenue crossing (DOT 762 836X) be permanently closed to vehicular traffic and vacated at the time the City places the appropriate barricades or end - treatment on both of the roadway approaches of each crossing at a distance of about 50 feet from the Main Track. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
