Ordinance No. 10,199ORDINANCE NO. 10,199 • AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING A ONE -TIME LUMP SUM EMERGENCY OPERATIONS ASSIGNMENT PAY FOR CERTAIN EMPLOYEES; MAKING OTHER PROVISIONS RELATED THERETO AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the 2005 Hurricane Season has been fraught with storms, which have caused widespread and severe damage, injury, and loss of life and property and severe economic and social disruption due to high winds and tidal surges and other public calamity resulting therefrom; and WHEREAS, since the 2005 Hurricane Season does not end until November 30, 2005, it is imperative that the City remain prepared throughout the remainder of the season to save lives, prevent injuries, protect property, public health, the environment and public safety to lessen or avert the threat of disaster; and WHEREAS, in recognition of the sacrifice required to be made by the City's essential personnel should the City of Baytown face the imminent threat of a hurricane in the future, the City Council desires to establish an emergency operations assignment pay for certain essential personnel; and WHEREAS, such essential personnel shall be required to perform specialized functions should the Emergency Operations Center be activated and shall include emergency services employees and other employees who provided for the safety and well -being of the general public and were necessary for the restoration of vital services of the City during Hurricane Rita on September 22 through noon September 24, 2005; and WHEREAS, the emergency operations assignment pay authorized herein is not and shall not be construed as extra compensation, pay or an allowance for services previously rendered; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the facts and matters set forth in the recitals of this Ordinance are hereby found to be true and correct and are hereby adopted as a part of this Ordinance. Section 2: That the City Council of the City of Baytown, Texas, hereby authorizes a one -time lump sum assignment pay of ONE HUNDRED TWENTY -FIVE AND NO /100 DOLLARS ($125.00) for those employees who performed services for and on behalf of the City under the direction of the Emergency Management and Preparedness Director on September 22, 2005, and who will perform like services for the remainder of the 2005 Hurricane Season. 0 • Section 3: That in addition to the assignment pay authorized in Section 2 hereof, the City Council of the City of Baytown, Texas, hereby authorizes an additional one -time lump sum assignment pay of TWO HUNDRED FIFTY AND NO /100 DOLLARS ($250.00) for those employees who performed services for and on behalf of the City under the direction of the Emergency Management and Preparedness Director from September 23, 2005 through noon September 24, 2005, and who will perform like services for the remainder of the 2005 Hurricane Season. Section 4: That the Director of Finance is hereby authorized and directed to include the assignment pay established herein in the payroll checks of qualifying essential personnel for the period ending November 30, 2005. Such assignment pay shall be made on December 5, 2005, and shall be subject to all payroll withholdings. Section 5: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
