• AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING CHANGE ORDER NO. 3 WITH LEM CONSTRUCTION CO., INC.,
FOR THE EAST DISTRICT WASTEWATER TREATMENT PLANT RENOVATION
PROJECT; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN, THE SUM
OF FORTY -THREE THOUSAND SIX HUNDRED EIGHTY -TWO AND 04/100
DOLLARS ($43,682.04); MAKING OTHER PROVISIONS RELATED THERETO;
AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section l: That the City Council does hereby authorize Change Order No. 3 with LEM
Construction Co., Inc., for the East District Wastewater Treatment Plant Renovation Project. A copy of
said change order is attached hereto, marked Exhibit "A," and made a part hereof for all intents and
purposes.
Section 2: That the City Council of the City of Baytown hereby authorizes the payment of
FORTY -THREE THOUSAND SIX HUNDRED EIGHTY -TWO AND 04 /100 DOLLARS ($43,682.04)
to LEM Construction Co., Inc., for Change Order No. 3 to the East District Wastewater Plant Renovation
Project.
Section 3: That pursuant to the provisions of Texas Local Government Code Annotated
5 252.048, the City Manager is hereby granted general authority to approve any change order involving a
decrease or an increase in costs of TWENTY -FIVE THOUSAND AND NO /100 DOLLARS
($25,000.00) or less, subject to the provision that the original contract price may not be increased by more
than twenty -five percent (25 %) or decreased by more than twenty -five percent (25 %) without the consent
of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.

Change Order No. 3
East District WWTP Rehabilitation of Influent Lift
Station No. 1, Treatment Train No.1, and Miscellaneous

Item No. 1
The existing air headers at Treatment Trains No. 2 and No. 3 are connected and only Treatment Train No. 3 can be
isolated based on the current air header arrangement. In order to complete the work in the treatment trains and to
provide needed operational capabilities at the plant, ball valves will need to be installed on the two hundred and
twenty (220) air drops at Treatment Tran No. 2. Attached is the cost breakdown from the contractor.

The four (4) new airlift pumps that will be installed at Treatment Trains No. 2 and No. 3 will require a method of
measurement of the return activated sludge coming from Clarifiers No. 2 and No. 3, per Chapter 217/317, Part
217.136 of the Texas Commission on Environmental Quality: Design Criteria for Sewage System. In order to
accomplish this rotometers will be installed on the air feed lines. Attached is the cost breakdown from the contractor.
