AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY
LIMITS OF THE CITY OF BAYTOWN, TEXAS, FOR A LIMITED PURPOSE
ONLY TO INCLUDE A 43.8056 ACRE TRACT OF LAND LOCATED EAST OF
SPRING GULLY AND NORTH OF INTERSTATE HIGHWAY NO. 10 IN
HARRIS COUNTY, TEXAS, WHICH SAID TERRITORIES LIE ADJACENT TO
AND ADJOIN THE PRESENT BOUNDARY LIMITS FOR THE CITY OF
BAYTOWN, TEXAS.
WHEREAS, there being no request for an "on- site" hearing, two public hearings before the
City Council of the City of Baytown, Texas, where all interested persons were provided with an
opportunity to be heard on the proposed limited purpose annexation of the property described in
Section 1 of this ordinance, were held, during the City Council meeting on the 23`d day of June,
2005, in the City Council Chamber of the City Hall of the City of Baytown, Texas, which date is not
more than forty (40) nor less than twenty (20) days prior to the institution of annexation proceedings;
b and
WHEREAS, notices of such public hearings were published in a newspaper having general
!� circulation in the City of Baytown, Texas, and in the below described territories on the 7`h day of
June, 2005, which date is not more than twenty (20) nor less than ten (10) days prior to the date of
such public hearings; and
WHEREAS, a notice of such public hearings was posted on the City ofBaytown's website on
0 the 7ch day of June, 2005, which date is not more than twenty (20) nor less than ten (10) days prior to
the date of such public hearings and remained posted until the date of the hearings; and
a WHEREAS, the total corporate area of the City of Baytown, Texas, on the 1 st day of January,
2005, was 32.43 square miles; and
WHEREAS, the population of the City of Baytown, Texas, is approximately 66,430
inhabitants; and
WHEREAS, the below described territories lie within the extraterritorial jurisdiction of the
City of Baytown, Texas; and
WHEREAS, the below described territories lie adjacent to and adjoin the City of Baytown,
Texas; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the following described land and territories lying adjacent to and
adjoining the City of Baytown are hereby added and annexed to the City of Baytown, Texas, for a

DESCRIPTION of a 43.8056 acre tract of land situated in the Nathaniel Lynch Survey,
Abstract 44, Harris County, Texas, and being all of that certain called 121.047 acre tract
of land conveyed by Evans Buick, OLDS, GMC, Inc. to Allen E. Russell, Trustee, by
Deed dated October 23, 1980 and recorded in County Clerk's File No. G736020 of the
Official Public Records of Real Property of Harris County, Texas. This 43.8056 acre
tract is more particularly described by the following metes and bounds, to -wit:

SERVICE PLAN FOR THE FIRE DEPARTMENT
RE: Proposed Annexation 43.8056 acres located east of Spring Gully, north of Interstate 10
This is a Limited Purpose Annexation and as such is provided no Fire Protection from the City
Baytown. However, if in the future Fire Protection is provided by the City of Baytown the following
is the service plan.
1. The area being annexed is described as: Tract of Land out of the Nathaniel Lynch Survey,
Abstract 44. Harris county. Texas.
2. The area will be assigned to the following service area: District 3. The newly annexed area will
receive the same services as other developments in the area.
3. What are the expected service delivery performance measures for the area within existing
resources?
a. First Due: 6 minutes. (2 miles) Response Time for receipt of call for services until the
arrival of the 18 due company. Time less than six minutes is required to confine the fire to
the room of origin increasing the probability of accomplishing the critical tasks of rescue,
fire control, and property conservation. EMS survivability from cardiac arrest increases
by 10% for each minute with BLS care before 6 minutes.
b. First Alarm: 13 minutes. (5.5 miles) Response Time for receipt of call for services until
the arrival of the first alarm assignment (2 Engines, 1 Ladder, 1 Chief) on location. The
time over 10 minutes will significantly increase fire spread and therefore decrease
rescue, fire control, and property conservation measures. Additionally, the return of
circulation for cardiac arrest victims without ALS care within 10 minutes diminishes
significantly.

SUBJ: Limited Service Annexation Plan — Spring Gully
This is our response to the proposed limited service annexation of the area near Spring Gully for
residential use.
Environmental Health
The continued incremental annexations of property combined with the increased demands for
service from citizens has caused a complete saturation of staff's capacity to provide service. To
continue to provide the same level of service to any additional annexations, without reducing
services to existing citizens, additional staff in EMS, Environmental Health and Neighborhood
Protection will be necessary. The necessary staff for EH and NP would be one Environmental
Health Specialist and one Neighborhood Protection Officer respectfully. The budgetary impact
of each would be approximately $50,000 for a total of $100,000.
As indicated in previous annexation comments the annexation of undeveloped property has little
impact on operational activities, however, as the properties are developed citizen demand for
service is immediate.
Emergency Medical Services
The decision to add or modify Emergency Medical Service resources are based on two primary
criteria: Call Volume and Response Times.
Call Volume
The requests for service that we receive vary by time of day, day of week. Our goal is to
maintain enough ambulances so that we are able to respond to every request for service, allowing
for hourly call volume fluctuations. Historically, each City EMS unit can handle an average of
2,400 requests for service each year without significantly impacting our ability to respond to
each call. Our failure to maintain adequate resources results in calls which are passed to
commercial ambulance firms, which do not maintain the same standards of care which we offer

to the citizens. We have 3 EMS units staffed each day, which gives us a call load limit of about
7,200 requests for service. Our call volume this year will approach 7,000 and we are forecasting
an increase to just over 7,100 for next year.
New development impacts our call volume. As an example, a growth in population of 120
individuals adds 1 call per month to our call volume. In this specific annexation request, it's
estimated that there will be 90 new homes, approximately 270 people added to the population of
Baytown. This equates to an increase in call volume of about 27 calls per year. While this may
not be the `trigger' to require additional response resources, other cumulative incremental growth
in Baytown may push anticipated call volume beyond 7,200 requests annually. This will require
the consideration of additional staffed ambulances to meet call volume demands.
Response Times
There are several sources for response time standards for Emergency Medical Services. The two
most noted are the National Fire Protection Association (NFPA) Standard 1710, and the U.S.
Department of Health and Human Services, National Institutes of Health, National Heart, Lung
and Blood Institute "Staffing and Equipping Emergency Medical Services Systems ". They both
state that Advanced Life Support (ALS) response should be 9 minutes or less, 90% of the time.
Using current staffing and deployment plans, response time computer modeling and historical
data, the area considered for annexation will fall out of the minimum ALS response time
standards.
There are other areas of the City which currently do not meet ALS response time standards,
notably Lakewood, Whispering Pines, and the Highway 146 /Chambers county corridor.
Recommendation
This area is outside of our normal response area and is currently served by Highlands Volunteer
Fire Department.
