AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
• ADDING 12.1300 ACRES OF LAND IN THE GEORGE C. DAVIS SURVEY,
ABSTRACT 1472, HARRIS COUNTY, TEXAS, LOCATED SOUTHEAST OF THE
INTERSECTION OF INTERSTATE HIGHWAY 10 AND NORTH MAIN STREET TO
COUNCIL DISTRICT NO. 4; REPEALING ORDINANCES INCONSISTENT
HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE
PUBLICATION AND EFFECTIVE DATE THEREOF.
WHEREAS, Section 17(l) of the Charter of the City of Baytown provides that the City Council shall
redistrict the City if the growth of the City justifies; and
WHEREAS, it is necessary to include the newly annexed territory described herein in a Council
District; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: Council District No. 4 is hereby redistricted by the addition of certain property which
is described on the attached Exhibit "A."
Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are
hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in
all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject
matter covered by this ordinance.
Section 3: If any provisions, section, exception, subsection, paragraph, sentence, clause or
phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason
be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining
provisions of this ordinance or their application to other persons or sets of circumstances and to this end all
provisions of this ordinance are declared to be severable.
Section 4: This ordinance shall take effect from and after ten (10) days from its passage by the
City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance
to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after
passage of this ordinance.

FIELD NOTES of a 12.1300 acre tract.of land situated in the George C. Davis Survey,
Abstract 1472, Harris County, Texas, and being out of and a part of that certain 23.304
acre tract of land conveyed by Troy J. Casey, et ux, to Ten Main, LTD, by Deed dated
December 11; 1969 and recorded in County Clerk's File No. D030921 of the Deed
Records of Harris County, Texas and part of that certain 0.1962 of an acre Landscape
Easement Tract conveyed by HGC, Limited Partnership, to Char, Inc. by Deed dated
December 21, 2001 and recorded in County Clerk's File No. V511224 of the Official
Public Records of Real Property of Harris County, Texas. This 12.1300 acre tract of land
is more particularly described by the following metes and bounds, to -wit:
NOTE: BEARINGS ARE GRID BEARINGS AND ALL COORDINATES REFER TO
THE STATE PLANE COORDINATE SYSTEM, SOUTH CENTRAL ZONE, NAD 83.
ALL DISTANCES ARE ACTUAL DISTANCES. SCALE FACTOR = 0.9998832.
REFERENCE IS MADE TO THE PLAT OF EVEN DATE ACCOMPANYING THIS
METES AND BOUNDS DESCRIPTION.
BEGINNING at a brass disc found in the West right -of -way line of Barkaloo Road (60
feet wide right -of -way; also known as Crosby -Cedar Bayou Road) at the Southeast corner
of said 23.304 acre tract and the Northeast comer of that certain 12.372 acre tract of land
conveyed by J. C. Noonan, Trustee, to George Gilman, Trustee, by Deed dated
November 10, 1978 and recorded in County Clerk's File No. F853137 of the Deed
Records of Harris County, Texas. Said point being the Southeast comer and POINT OF
BEGINNING of this tract and having a State Plane Coordinate Value of Y=
13,838,112.08 and X = 3,243,765.13.
THENCE: South 77 °29' 14" West along the South line of this tract, the South line of said
23.304 acres and the North line of said 12.372 acres for a distance of 928.09 feet to a
inch iron rod, with cap, set in the East right -of -way line of North Main Street (100 feet
wide right -of -way) and the West line of said 23.304 acres for the Northwest comer of
said 12.372 acres, the Southwest comer of said 23.304 acres and the Southwest corner of
this tract.
THENCE: North 12 °49'50" West along the Southernmost West line of this tract, the
West line of said 23.304 acres and the East right -of -way line of said North Main Street
for a distance of 400.00 feet to a %Z inch iron rod, with cap, set for the Westernmost
Northwest corner of this tract and the Westernmost Southwest comer of the residue of
said 23.304 acres.
THENCE: North 77'29'13" East along the Westernmost North line of this tract and the
Westemmost South line of said residue tract for a distance of 479.80 feet to a %s inch iron
rod, with cap, set for an interior comer of this tract and the Southernmost Southeast
corner of said residue tract.

Southernmost East line of said residue tract for a distance of 195.03 feet to a point for an
interior comer of this tract and an exterior comer of said residue tract.
THENCE: South 77 °09'39" West along an interior line of this tract and an exterior line
of said residue tract and at a distance of 30.00 feet pass a point for the Southeast comer of
that said 0.1962 of an acre Landscape Easement Tract; in all, a total distance of 40.00 feet
to a point for an exterior comer of this tract.
THENCE: North 12 050'21" West along the Northernmost West line of this tract and an
interior line of said Landscape Easement Tract and at 10.00 feet pass an interior South
line of said Landscape Easement Tract; in all, a total distance of 149.23 feet to a point for
the Northernmost Northwest corner of this tract.
THENCE: North 77'29'13" East along the Northernmost North line of this tract, over
and across said Landscape Easement Tract, for a distance of 10.00 feet to a point in the
Northernmost East line of said Landscape Easement Tract for an exterior Northeast
corner of this tract.
THENCE: South 12 °50'21" East along an exterior East line of this tract and the
Northernmost East line of said Landscape Easement Tract for a distance of 10.00 feet to a
point for an interior corner of this tract and an exterior comer of said residue tract.
THENCE: North 77 °29' 13" East along the Easternmost North line of this tract and the
Easternmost South line of said residue tract for a distance of 483.07 feet to a' /z inch iron
rod, with cap, set in the West right -of -way of said Barkaloo Road (also known as Crosby -
Cedar Bayou Road) and the East line of said 23.304 acres for the Easternmost Northeast
comer of this tract and the Easternmost Southeast comer of said residue tract.
THENCE: South 12 °27'42" East along the East line of this tract, the East line of said
23.304 acres and the West right -of -way line of Barkaloo Road (also known as Crosby -
Cedar Bayou Road) for a distance of 734.03 feet to the PLACE OF BEGINNING and
containing within these boundaries 12.1300 acres of land.
