ORDINANCE NO. 9993 2005 and Thursday,
February 10, 2005
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
ADDING 140 ACRES OF LAND LOCATED IN THE WILLIAM BLOODGOOD
SURVEY, A-4, AND THE J.P. SJOLANDER SURVEY, A -1644, SOUTH OF
NEEDLEPOINT ROAD AND EAST OF SJOLANDER ROAD AND THE ADJACENT
PORTION OF NEEDLEPOINT ROAD IN HARRIS COUNTY, TEXAS, TO COUNCIL
DISTRICT NO. 5; REPEALING ORDINANCES INCONSISTENT HEREWITH;
CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION
AND EFFECTIVE DATE THEREOF.
WHEREAS, Section 17(1) of the Charter of the City of Baytown provides that the City Council shall
redistrict the City if the growth of the City justifies; and
WHEREAS, it is necessary to include the newly annexed territory described herein in a Council
District; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: Council District No. 5 is hereby redistricted by the addition of certain property which
is described on the attached Exhibit "A."
Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are
hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all
other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject
matter covered by this ordinance.
Section 3: Ifanyprovisions, section, exception, subsection, paragraph, sentence, clause orphrase
of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held
unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this
ordinance or their application to other persons or sets of circumstances and to this end all provisions of this
ordinance are declared to be severable.
Section 4: This ordinance shall take effect from and after ten (10) days from its passage by the
City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance
to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after
passage of this ordinance.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of
Baytown this the 31" day of January, 2005.

BEGINNING at a 1 inch iron pipe found and accepted, as the northwest corner of said 93
acre tract, said point being in the southerly line of Needle Point Road (60'R.O.W.), and
said point have State Plane Coordinates N 13866344.75 E 3257836.37, South Central

THENCE N 77 deg. 37 min. 10 sec. E 819.64 feet along the southerly line of Needle
Point Road (60' R.O.W.) to a found 1 inch iron pipe marking the northwesterly corner of

THENCE S 24 deg. 45 min. 07 sec. W 1291.62 feet along the northwesterly line of

THENCE N 12 deg. 34 min. 11 sec. W, over and across said Needlepoint Road, a
distance of 60.00 feet, to a point for corner for the northwest corner of the herein
desc'bed tract;
THENCE N 77 deg. 25 min. 49 sec. E along the north line of Needlepoint Road, a
distance of 140 feet, to the west line of a called 53.12 acre tract, Share `B ", as described
in Ordinance No. 1795;
THENCE S 12 deg. 34 min. 11 sec. E over and across a portion of Needlepoint Road a
distance of 30 feet, to a point for corner of the herein described tract;

52.142 acres (2,271,330 square feet) out of a called 87.472 acre tract of land recorded in
Clerk's File No. T309427 of the Harris County Official Public Records of Real Property
(H.C.O.P.R.R.P.) and also being out of the William Bloodgood Survey, A -4, Harris
County, Texas and more particularly described by metes and bounds as follows:
BEGIl4NING at a 1 -inch iron pipe found in the southerly line of Needle Point Road (60'
R.O.W.) as fenced, and from which the called northwest corner of said 87.472 acre tract
bears North 16 deg. 03 min. 07 sec. West, 3.60 feet;
THENCE North 77 deg. 38 min. 25 sec. East, 812.21 feet along the southerly line of
Needle Point Road (60' R.O.W.) as fenced to a found 1/4" iron pipe marking the
northwesterly corner of a called 43.1651 acre tract recorded in Clerk's File No. V726885
of the H.C.O.P.R.R.P., and the northeasterly corner of the herein described tract, and
from which a found 5/8" iron rod marking the northeasterly corner of the aforementioned
87.472 acre tract bears North 13 deg. 06 min. 49 sec. West, 7.24 feet;
THENCE South 12 deg. 48 min. 23 sec. East, along the westerly line of said 43.1651 acre
tract and the easterly line of the herein described tract, passing at 2,203.84 feet a found
' /z" iron rod, and continuing for a total distance of 2,272.45 feet to a set 5/8" iron rod with
cap for the southeasterly corner of the herein described tract, same being the northeasterly
corner of the called 3.055 acre Save and Except tract referenced in C.F. No. T309427,
said set 5/8" iron rod also being located on the northerly line of the Dayton -Goose Creek
RR Co. right -of -way as recorded in Volume 390, Page 431, H.C.D.R.;
THENCE South 24 deg. 49 min. 51 sec. West, 1,325.49 feet along the northwesterly line
of Dayton -Goose Creek RR Co. to a found 5/8" iron rod with cap being the southwesterly
comer of the herein described tract, said 5/8" iron rod being located in the easterly line of
a called 93 acre tract recorded in Clerk's File Nos. C334213 and M062663 of the
H.C.O.P.R.R.P.;
THENCE North 12 deg. 51 min. 14 sec. West, 3,328.43 feet along the easterly line of
said 93 acre tract, and the westerly line of the herein described tract, to the POINT OF
BEGINNING, and containing 52.142 acres (2,271,330 square feet) of land.
Note: The POINT OF BEGINNING of the foregoing property description has
coordinates of North = 13,866,519.81 East = 3,258,636.95 (All bearings and coordinates
are based on the Texas Plane Coordinate System, South Central Zone, NAD 83; all
coordinates shown are grid, all distances shown are surface).
Tract 4--- 14.727 acres
Being 14.727 acres (641,547 square feet) of land out of that called 15.168 acre tract
described in Clerk's File No. M209839, H.C.O.P.R.R.P., being out of the William
Bloodgood Survey, A -4, Harris County, Texas, and being more particularly described by
metes and bounds as follows:
BEGINNING at a 1" iron pipe found and accepted as the common point marking the
northeasterly comer of said 15.168 acre tract and the northwesterly corner of that called
93 acres described in Clerk's File Nos. C334213 & M062663, H.C.O.P.R.R.P., said point
being in the southerly line of Needlepoint Road (called 60' wide), said point having a
Texas State Plane Grid Coordinate, South Central Zone, of N = 13,866,519.81, E _
3,258,636.95, NAD 83;
THENCE S 13 deg. 00 min. 58 sec. E, 266.25 feet along the westerly line of said 93 acre
tract to a %Z" iron rod found marking the southeasterly corner of the herein described tract
and the northeasterly comer of that 10.800 acre tract described in Clerk's File No.
M566085, H.C.O.P.R.R.P.;
THENCE S 77 deg. 15 min. 53 sec. W, 2431.48 feet along the common boundary
between said 15.168 & 10.800 acre tracts to a 1" iron pipe found in the easterly line of
Sjolander Road (variable width);
THENCE N 09 deg. 23 min. 15 sec. W, 263.73 feet along an existing fence line marking
the apparent easterly line of Sjolander Road to a 5/8" iron rod set to mark the
northwesterly comer of the herein described tract, said point being in the southerly line of
Needlepoint Road;
THENCE N77 deg. 11 min. 40 sec. E, 2414.78 feet along an existing fence line marking
the apparent southerly line of Needlepoint Road to the POINT OF BEGINNING.
