ORDINANCE NO. 9973
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE
CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF A 30.374 -ACRE
TRACT SITUATED IN THE W.C.R.R. COMPANY SURVEY NUMBER 1,
ABSTRACT 899, LOCATED NORTH OF ARCHER ROAD AND WEST OF GARTH
ROAD IN HARRIS COUNTY, TEXAS; WHICH SAID TERRITORIES LIE
ADJACENT TO AND ADJOIN THE PRESENT BOUNDARY LIMITS FOR THE
CITY OF BAYTOWN, TEXAS.
WHEREAS, there being no request for an "on- site" hearing, two public hearings before the City
Council of the City of Baytown, Texas, where all interested persons were provided with an opportunity to
be heard on the proposed annexation of the property described in Section 1 of this ordinance, were held,
during the City Council meeting on the 9'h day of December, 2004, in the City Council Chamber of the
City Hall of the City of Baytown, Texas, which date is not more than forty (40) nor less than twenty (20)
days prior to the institution of annexation proceedings; and
WHEREAS, notices of such public hearings were published in a newspaper having general
circulation in the City of Baytown, Texas, and in the below described territories on the 26'h day of
November, 2004, which date is not more than twenty (20) nor less than ten (10) days prior to the date of
such public hearings; and
WHEREAS, a notice of such public hearings was posted on the City of Baytown's website on the
26'h day of November, 2004, which date is not more than twenty (20) nor less than ten (10) days prior to
the date of such public hearings and remained posted until the date of the hearings; and
WHEREAS, the total corporate area of the City of Baytown, Texas, on the I" day of January,
2004, was 32.43 square miles; and
WHEREAS, the population of the City of Baytown, Texas, is approximately 66,430 inhabitants;
and
WHEREAS, the below described territories lie within the extraterritorial jurisdiction of the City
of Baytown, Texas; and
WHEREAS, the below described territories lie adjacent to and adjoin the City of Baytown,
Texas; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section L That the following described land and territories lying adjacent to and adjoining
the City of Baytown are hereby added and annexed to the City of Baytown, Texas, and shall hereinafter
be included within the boundary limits of the City of Baytown, Texas, and present boundary limits of
such City, at the various points contiguous to the areas hereinafter described, are altered and amended so
as to include said areas within the corporate limits of the City of Baytown, Texas, to -wit:

® Section 2: The above described territories and the areas so annexed shall be a part of the
City of Baytown, Texas, and the property so added hereby shall bear its pro rata of the taxes levied by the
® City of Baytown, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of
all the citizens of the City of Baytown and shall be bound by the acts, ordinances, resolutions, and
regulations of the City of Baytown, Texas.
Section 3: In accordance with Texas Local Government Code Annotated § 43.056, as
amended, the service plan prepared by the City for providing municipal services to the annexed areas is
attached as Exhibit "B" and is hereby approved.
Section 4: This ordinance shall be published and passed in the manner provided in Article 1,
Section 9, of the Charter of the City of Baytown, Texas.

SUMMARY

The area to be annexed is located in the ET], located west on Garth Road, north of
Archer Road.
Size of Area: The area proposed for annexation} is 30.374 acres shown on the attached
map.
Pro sed Land Use: Multi- family development, consisting of 250 dwelling units.. Upon
annexation, the property will be in the Mixed Use (MU) zoning district.
Impact: As a result of this proposed annexation:
The Fire Department will deliver the same services as other developments in the area.
The Response Time for receipt of call for services until the arrival of the 1' due
company 4 minutes. Fire will be confined to the room of origin increasing the probability
of accomplishing the critical task of rescue, fire control, and property conservation. EMS
survivability from cardiac arrest increase by 10% for each minute with BLS care before
6 minutes. The Response Time for receipt of call for services until the arrival of the 1'
alarm assignment (2 Engines, 1 Ladder, 1 Chief) on location, 12 minutes 12 seconds.
The time over 10 minutes will significantly increase fire spread and therefore decrease
rescue, fire control, and property conservation measures. Additionally, the return of
circulation for cardiac arrest victims without ALS care within 10 minutes diminishes
significantly. To improve the service delivery performance measures to the proposed
area the initial investment for construction of a new building, equipment and personnel
is $2,165,000 with a recurring cost of $1,039,900. (See attached Service Plan). The
project site will be assigned to Fire Station 1.
The Police Department indicates that the proposed annexation will increase area to be
patrolled, as well as increase amount of workload and an increase to crime rate is to be
anticipated. In addition, an increase in workload and response times to current
residents is to be anticipated. Preventative patrol time will decrease with additional
workload. The project site will be assigned to Police District 2. (See attached Service
Plan).
The Public Works and Utilities Department workload will increase and the divisions work
backlog will increase. (See attached Service Plan).
The Health Department states that future annexation and development will increase the
demand for services and decrease our ability to meet Advance Life Support (ALS)
® response standards. To improve the service delivery performance measures to the
proposed area the initial investment for construction of a new building, equipment and
personnel is $1,375,000. (See attached memo)
Means of Accomplishment: The annexation will be accomplished from the existing city
limit line.
Public Input: Public Hearings will be held to allow for public input.
Attachments: Attached to this summary are the specific Service Plan elements
submitted by each of the major city departments.

but it will improve the second company's response time greatly. As the TIRZ and the
® area north of Interstate 10 and Garth Road develop it may be time to have an
independent study completed of the city's fire forces to possibly look' at the efficiencies of
® relocating all city fire stations to improve fire and Advanced Life Support responses. The
last study was completed in the mid 1980's.

The continued incremental annexations of property combined with the increased demands for
service from citizens has caused a complete saturation of staffs capacity to provide service. To
continue to provide the same level of service to any additional annexations, without reducing
services to existing citizens, additional staff in EMS, Environmental Health and Neighborhood
Protection will be necessary. (See attached EMS response) The necessary staff for EH and NP
would be one Environmental Health Specialist and one Neighborhood Protection Officer
respectfully. The budgetary impact of each would be approximately $50,000 for a total of
$100,000.
As indicated in previous annexation comments the annexation of undeveloped property has little
impact on operational activities, however, as the.properties are developed citizen demand for
service is immediate.

Annexation Service Plan
This is our response to the proposed annexation of 30.374 acres located on Garth Road, north of
Archer Road, West of Garth Road for use as a multi- family development.
The decision to add or modify Emergency Medical Service resources are based on two primary
criteria: Call Volume and Response Times.
Call Volume
The requests for service that we receive vary by time of day, day of week. Our goal is to
maintain enough ambulances so that we are able to respond to every request for service, allowing
for hourly call volume fluctuations. Historically, each City EMS unit can handle an average of
2,400 requests for service each year without significantly impacting our ability to respond to
each call. Our failure to maintain adequate resources results in calls which are passed to
commercial ambulance firms, which do not maintain the same standards of care which we offer
to the citizens. We have 3 EMS units staffed each day, which gives us a call load limit of about
7,200 requests for service. Our call volume this year will approach 7,000 and we are forecasting
an increase to just over 7,100 for next year.
New development impacts our call volume. As an example, a growth in population of 120
individuals adds 1 call per month to our call volume. In this specific annexation request, it's
estimated that there will be 250 apartments, approximately 500 people added to the population of
Baytown. This equates to an increase in call volume of about 50 calls per year. While this may
not be the `trigger' to require additional response resources, other cumulative incremental growth
in Baytown may push anticipated call volume beyond 7,200 requests annually. This will require
the consideration of additional staffed ambulances to meet call volume demands.
Response Times
There are several sources for response time standards for Emergency Medical Services. The two
most noted are the National Fire Protection Association (NFPA) Standard 1710, and the U.S.
is Department of Health and Human Services, National Institutes of Health, National Heart, Lung

and Blood Institute "Staffing and Equipping Emergency Medical Services Systems ". They both
state that Advanced Life Support (ALS) response should be 9 minutes or less, 90% of the time.
Using current staffing and deployment plans, response time computer modeling and historical
data, the area considered for annexation will meet the minimum ALS response time standards.
Recommendation
Future annexation and development will not only increase the demand for services, but will also
decrease our ability to meet ALS response standards.
Estimated Costs
Buildings — Construction of a facility to house an ALS ambulance and crew 24 hours per
day in the northeast section of Baytown. Approximate Cost $750,000.
Vehicles — One Type 1, Class I Modular Ambulance. Approximate Cost $130,000.
Additional Personnel — Four (4) Paramedics, Three (3) Senior Paramedics to staff the
ambulance. Approximate Cost $350,000.
Capital Equipment — Minimum essential equipment for the new ambulance, to include
12 -lead EKG Monitor, Stretcher, Carry -in Bags, Extrication Equipment, 2 -way radios for
ambulance, portable radios for crew. Approximate Cost $45,000

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
ADOPTING NEW FEES FOR THE RENTAL OF THE ROSELAND PARK PAVILION
FOR NON -CITY SPONSORED EVENTS; REPEALING CONFLICTING
ORDINANCES; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the Parks and Recreation Advisory Board has approved and recommends the rental
fees for the Roseland Park Pavilion be increased; and
WHEREAS, such fee increases are designed to compensate the City, in part, for the actual
expenses incurred in providing the facilities; and
WHEREAS, the City Council has reviewed such fees and finds that such fees are fair and
reasonable and compensate the City, in part, for the facilities provided; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:

the rental of the Roseland Park Pavilion for non -city sponsored events detailed in Exhibit "A," which is
attached hereto and made a part hereof for all intents and purposes.
Section 2: All ordinances or parts of ordinances inconsistent with the ternis of this
ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such
inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating
and governing the subject matter covered by this ordinance.
Section 3: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
