Ordinance No. 9,938ORDINANCE NO. 9938 ® AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER AND THE CITY CLERK OF THE CITY OF BAYTOWN TO EXECUTE AND ATTEST TO A CONTRACT AMENDMENT WITH TEXAS DEPARTMENT OF TRANSPORTATION FOR SUPPLEMENTAL FUNDING FOR PHASE III OF THE GOOSE CREEK STREAM GREENBELT TRAIL; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes and directs the City Manager and the City Clerk of the City of Baytown to execute and attest to a contract amendment with Texas Department of Transportation for supplemental funding for Phase III of the Goose Creek Stream Greenbelt Trail. A copy of said amendment is attached hereto, marked Exhibit "A," and made a part hereof for all intents and purposes. Section 2: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. WHEREAS, the State and the City executed an agreement on the 15t' day of February 1995 concerning the construction of a multipurpose bicycle /pedestrian facility with landscaping and historic preservation from SH 146 to Decker Drive along Goose Creek in Baytown; and WHEREAS, the State and the City executed amendment 1 to the agreement on the Td day of March 2000 which added supplemental Congestion Mitigation and Air Quality (CMAQ) funds to the original enhancement funds; and WHEREAS, the portion of the project from SH 146 to the end of Arizona Street (Phase 1) has been let to contract by the State and construction has been completed; and WHEREAS, the cost of the Phase 2 project from the end of Arizona Street to Decker Drive has increased significantly from the original allocated enhancement funds and from the supplemental CMAQ funds; and WHEREAS, on the 27th day of February 2004 the Metropolitan Planning Organization passed Amendment 78 to the Transportation Improvement Program, which is attached to October 28, 2004 EXHIBIT A ® this Amendment as Attachment G t hat i ncreases t he F ederal f unds a vailable f or t he project; and • WHEREAS, on the 9th day of September 2004 the Metropolitan Planning Organization passed Amendment 115 to the Transportation Improvement Program, which is attached to this Amendment as Attachment H that increases the Federal funds available for the project; and WHERAS, amendment 1 to the agreement assigned two new exhibits to the agreement and the letters assigned to these exhibits conflicts with exhibits in the original agreement; and WHEREAS, these changes necessitate the amendment of the agreement. NOW THEREFORE, it is agreed to amend certain segments of the Baytown Goose Creek Hike and Bike Trail project funding agreement as follows: Paragraphs A and B of Section 5 of the Agreement are voided in their entirety and replaced with the following: A. The estimated total cost of all phases of the Project, including construction engineering and testing services, is $2,560,750. Congestion Mitigation and Air Quality funding will total $1,156,250 and Enhancement funding will total $1,404,500. B. The State will be responsible to secure the federal share of funding required for the development and construction of all phases of the Project. The federal share for the development and construction of all phases of the Project is eighty percent (80 %) of the total estimated cost of all phases of the Project, not to exceed $2,048,600. The Federal portion of the Congestion Mitigation and Air Quality funding will total $925,000 and Enhancement funding will total $1,123,600. The City will be responsible to comply with the cost principles established in OMB Circular A -87, "Cost Principles for State and Local Governments" and for any non- federal participation costs associated with all phases of the Project. 2. The original agreement is also modified by this amendment to include "Exhibit E — 2000 -2002 Transportation Improvement Program Page 37 of 57 which is attached hereto and made part hereof. This Exhibit replaces Exhibit A of Amendment 1 which is hereby voided. 3. The original agreement is also modified by this amendment to include "Exhibit F — 2000 Transportation Improvement Program Page 4 of 57 which is attached hereto and made part hereof. This Exhibit replaces Exhibit B of Amendment 1 which is hereby voided. October 28, 2004 2 • 4. It is funded with Congestion Mitigation Air Quality (CMAQ) funds and currently scheduled to let in FY 2005. 2004-2006 TIP Amendment Number .77 approved by the Metropolitan Planning Organization on February 27,.2004, modified the funding for the subject project. CSJ 0110 -03 -049 is listed in the 2004 -2006 TIP on page 2 -88 and it is funded with CMAQ. The City of Baytown sent a letter dated May 14, 2004 requesting an additional $250,000 in CMAQ funds to assure the success of the trail. The Goose Creek Trail has been under design for many years and in the interim the cost of various bid items increased with inflation: The cost increase is also due to construction cost and the unanticipated cost of construction management. WHEREAS, the State and the City executed an agreement on the 15th day of February 1995 concerning the construction of a multipurpose bicycle/pedestrian facility with landscaping and historic preservation from SH 146 to Decker Drive along Goose Creek in Baytown; and WHEREAS, the State and the City executed amendment 1 to the agreement on the 3rd day of March 2000 which added supplemental Congestion Mitigation and Air Quality (CMAQ) funds to the original enhancement funds; and WHEREAS, the portion of the project from SH 146 to the end of Arizona Street (Phase 1) has been let to contract by the State and construction has been completed; and WHEREAS, the cost of the Phase 2 project from the end of Arizona Street to Decker Drive has increased significantly from the original allocated enhancement funds and from the supplemental CMAQ funds; and WHEREAS, on the 27th day of February 2004 the Metropolitan Planning Organization passed Amendment 78 to the Transportation Improvement Program, which is attached to October 28, 2004 1 this Amendment as Attachment G t hat i ncreases t he F ederal f unds a vailable f or t he project; and WHEREAS, on the 9th day of September 2004 the Metropolitan Planning Organization passed Amendment 115 to the Transportation Improvement Program,which is attached to this Amendment as Attachment H that increases the Federal funds available f or t he project; and WHERAS, amendment 1 to the agreement assigned two new exhibits to the agreement and the letters assigned to these exhibits conflicts with exhibits in the original agreement; and WHEREAS, these changes necessitate the amendment of the agreement. NOW THEREFORE, it is agreed to amend certain segments of the Baytown Goose Creek Hike and Bike Trail project funding agreement as follows: 1. Paragraphs A and B of Section 5 of the Agreement are voided in their entirety and replaced with the following: A. The estimated total cost of all phases of the Project, including construction engineering and testing services, is $2,560,750. Congestion Mitigation and Air Quality funding will total $1,156,250 and Enhancement funding will total 1,404,500. B. The State will be responsible to secure the federal share of funding required for the development and construction of all phases of the Project. The federal share for the development and construction of all phases of the Project is eighty percent 80%) of the total estimated cost of all phases of the Project, not to exceed 2,048,600. The Federal portion of the Congestion Mitigation and Air Quality funding will total $925,000 and Enhancement funding will total $1,123,600. The City will be responsible to comply with the cost principles established in OMB Circular A-87, "Cost Principles for State and Local Governments"and for any non- federal participation costs associated with all phases of the Project. 2. The original agreement is also modified by this amendment to include "Exhibit E — 2000-2002 Transportation Improvement Program Page 37 of 57 which is attached hereto and made part hereof. This Exhibit replaces Exhibit A of Amendment 1 which is hereby voided. 3. The original agreement is also modified by this amendment to include"Exhibit F—2000 Transportation Improvement Program Page 4 of 57 which is attached hereto and made part hereof. This Exhibit replaces Exhibit B of Amendment 1 which is hereby voided. October 28, 2004 2 4. All other terms and conditions of the contract are unchanged and remain in full force and effect. It is funded with Congestion Mitigation Air Quality (CMAQ) funds and currently scheduled to let in FY 2005. 2004-2006 TIP Amendment Number 77 approved by the Metropolitan Planning Organization on February 27,.2004, modified the funding for the subject project. CSJ 0110-03-049 is listed in the 2004-2006 TIP on page 2-88 and it is funded with CMAQ. The City of Baytown sent a letter dated May 14, 2004 requesting an additional $250,000 in CMAQ funds to assure the success of the trail. The Goose Creek Trail has been under design for many years and in the interim the cost of various bid items increased with inflation. The cost increase is also due to construction cost and the unanticipated cost of construction management. At this time, TxDOT is requesting to transfer $180,000 in CMAQ from CSJ 0110-03-049 to cover the cost overrun in CSJ 0912-71-698.
