AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY
LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF
LOT 14 OF HURON SUBDIVISION, HARRIS COUNTY, TEXAS; WHICH SAID
TERRITORIES LIE ADJACENT TO AND ADJOIN THE PRESENT BOUNDARY
LIMITS FOR THE CITY OF BAYTOWN, TEXAS.
WHEREAS, there being no request for an "on- site" hearing, two public hearings before the
City Council of the City of Baytown, Texas, where all interested persons were provided with an
opportunity to be heard on the proposed annexation of the property described in Section 1 of this
ordinance, were held, during the City Council meeting on the 24`h day of June, 2004, in the City
Council Chamber of the City Hall of the City of Baytown, Texas, which date is not more than forty
(40) nor less than twenty (20) days prior to the institution of annexation proceedings; and
WHEREAS, notices of such public hearings were published in a newspaper having general
circulation in the City of Baytown, Texas, and in the below described territories on the 10th day of
June, 2004, which date is not more than twenty (20) nor less than ten (10) days prior to the date of
such public hearings; and
WHEREAS, a notice of such public hearings was posted on the City of Baytown's website on
the 21St day of June, 2004, which date is not more than twenty (20) nor less than ten (10) days prior
to the date of such public hearings and remained posted until the date of the hearings; and
WHEREAS, the total corporate area of the City of Baytown, Texas, on the 1 st day of January,
2004, was 32.43 square miles; and
WHEREAS, the population of the City of Baytown, Texas, is approximately 66,430
inhabitants; and
WHEREAS, the below described territories lie within the extraterritorial jurisdiction of the
City of Baytown, Texas; and
WHEREAS, the below described territories lie adjacent to and adjoin the City of Baytown,
Texas; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the following described land and territories lying adjacent to and
adjoining the City of Baytown are hereby added and annexed to the City of Baytown, Texas, and
shall hereinafter be included within the boundary limits of the City of Baytown, Texas, and present
boundary limits of such City, at the various points contiguous to the areas hereinafter described, are
® altered and amended so as to include said areas within the corporate limits of the City of Baytown,
Texas, to -wit:

® Section 2: The above described territories and the areas so annexed shall be a part of the
City of Baytown, Texas, and the property so added hereby shall bear its pro rata of the taxes levied
by the City of Baytown, Texas, and the inhabitants thereof shall be entitled to all of the rights and
privileges of all the citizens of the City of Baytown and shall be bound by the acts, ordinances,
resolutions, and regulations of the City of Baytown, Texas.
Section 3: In accordance with Texas Local Government Code Annotated § 43.056, as
amended, the service plan prepared by the City for providing municipal services to the annexed areas
is attached as Exhibit 'B" and is hereby approved.
Section 4: This ordinance shall be published and passed in the manner provided in
Article 1, Section 9, of the Charter of the City of Baytown, Texas.

SUMMARY
The area to be annexed is located in the M. The proposed annexation of 2 acres
located south of Interstate 10, west of North Main.
Size of Area: The area proposed for annexation is approximately 2 acres shown on the
attached map.
Proposed Land Use: Commercial. Upon annexation, the property will be in the Mixed
Use (MU) zoning district.
Impact: As a result of this proposed annexation, the Fire Department states that the
proposed annexation will put a strain on the response capabilities for Baytown Fire and
Rescue Services (see attached memo) and the Health Department mentions that when
the land is developed citizen demand for related services will increase and additional
facilities, vehicles and personnel will be required. For fire protection purposes, the
project site will be assigned to Fire Station 1 and Police District 3.
Means of Accomplishment: The annexation will be accomplished from the existing city
limit line.
Public Input: Public Hearings will be held to allow for public input.
Attachments: Attached to this summary are the specific Service Plan elements
submitted by each of the major city.

Subject: Annexation Service Plan for 2 -acre tract on Interstate 10
The proposed annexation of the 2 -acre tract within the ETJ, located south of
Interstate 10 lies outside adequate response capabilities of Baytown Fire &
Rescue Services. This area lies approximately 3 miles from Fire Station 1
located at 4723 Garth Road, which is the nearest location to provide for fire and
medical response.
Our performance measurement for fire suppression and emergency medical
incidents is four minutes or less for the arrival of the first Engine Company and
eight minutes or less for the deployment of a full first alarm assignment. In
conjunction with time performance measurements we also take into
consideration travel distance as a response measurement. This area is well
outside either of these performance measurements.
There are two possible options to meet our performance objective for this area.
1. We may be able to provide adequate protection by relocating existing fire
stations. While this will require no additional personnel it may require
relocating as many as five fire stations. While this may alleviate the
problem in the northern section of our City it will leave a gap in the
southern section.
A comprehensive fire location study will need to be conducted to see if this
option will meet our performance objectives.
2. Build, equip, and staff a fire station located in the area of 1 -10 and
Needlepoint. This will meet our performance objectives in the proposed
annexation area. It will provide for future annexation growth in the 1 -10
corridor between Garth and Highway 146 and meet our performance
objectives.
a. Building: 1 four bay fire station
b. Equipment: 1 Pierce Engine
c. Staffing: 15 firefighters (3 Lieutenants, 3 Equipment Operators, 9
firefighters).
