Ordinance No. 9,791ORDINANCE NO. 9791 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, ® TEXAS, AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AND THE CITY CLERK TO ATTEST TO AN AMENDMENT TO THE INTERLOCAL AGREEMENT WITH THE CITY OF HOUSTON FOR THE HARRIS COUNTY ORGANIZED CRIME AND NARCOTICS TASK FORCE GRANT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes and directs the City Manager to execute and the City Clerk to attest to an Amendment to the Interlocal Agreement with the City of Houston for the Harris County Organized Crime and Narcotics Task Force Grant. A copy of said amendment is attached hereto, marked Exhibit "A," and made a part hereof for all intents and purposes. Section 2: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. INTERLOCAL AGREEMENT FOR THE HARRIS COUNTY ORGANIZED CRIME AND NARCOTICS TASK FORCE GRANT DI STATE OF TEXAS § COUNTY OF HARRIS § This First Amendment ( "Amendment ") to that certain "Interlocal Agreement for the Harris County Organized Crime and Narcotics Task Force Grant" by and between the City of Baytown ( "Baytown ") and the City of Houston ( "Houston "), authorized by the City Council of the City of Baytown on the 12`h day of June, 2003, (the "Agreement ") is made by and between the same parties on the date hereinafter last specified. WITNESSETH: WHEREAS, Baytown and Houston have discovered that the following was inadvertently left out of the Agreement: Houston agrees to perform those services described as analysis, categorizing, tagging, storage, preservation and court- ordered destruction of all illicit drugs /narcotics seized and submitted by personnel assigned to the Force. Such services are to be provided by the Houston Police Department Crime Lab. As consideration for such services, Baytown agrees to reimburse Houston in the amount of $37,500 for equipment costs incurred by the Houston Police Department Crime Lab. WHEREAS, Houston has performed and desires to continue to perform such services for the Harris County Organized Crime and Narcotics Task Force; and WHEREAS, Baytown, as grant recipient for the Harris County Organized Crime and Narcotics Task Force, desires to pay Houston for services performed and to be performed; NOW THEREFORE, for and in consideration of the mutual covenants and agreements herein contained, the parties hereto do hereby mutually agree as follows: I. Unless a different meaning clearly appears from the context, words and phrases as used in this Amendment shall have the same meanings as in the Agreement. First Amendment, Page 1 E=ff A II. ® Section 3.05 shall be added to the contract to read as follows: v 3.05 Houston agrees to perform those services described as analysis, categorizing, tagging, storage, preservation and court- ordered destruction of all illicit drugs /narcotics seized and submitted by personnel assigned to the Force. Such services are to be provided by the Houston Police Department Crime Lab. As consideration for such services, Baytown agrees to reimburse Houston in the amount of $37,500 for equipment costs incurred by the Houston Police Department Crime Lab. III. The provisions of this Amendment and the provisions of the Agreement should be read together and construed as one agreement provided that, in the event of any conflict or inconsistency between the provisions of this Amendment and the provisions of the Agreement, the provisions of this Amendment shall control. Nothing herein or in the Agreement shall be construed as to limit or waive the sovereign immunity of Baytown.
