AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING AND DIRECTING THE CITY MANAGER TO SEND
NOTICE TO VERIZON SOUTHWEST TO RENEW THE CENTRANET
TELEPHONE SERVICES AGREEMENT FOR A ONE -YEAR PERIOD; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the City of Baytown entered into an agreement on December 15, 2000, with
GTE Southwest Incorporated d/b /a Verizon Southwest ( "Verizon ") in its capacity as an incumbent
local exchange carrier for CentraNet services; and
WHEREAS, such agreement was amended on January 16, 2002; and
WHEREAS, the agreement was for a term of three years with one one -year renewal option
under the same terms and conditions; and
WHEREAS, in order to exercise the renewal option, the City must provide Verizon with
written notice invoking the option at least 30 days prior to the end of the initial termination date,
which is December 15, 2003; and
WHEREAS, service from Verizon has been satisfactory during the original term of the
agreement and the same is expected for the renewal period; and
WHEREAS, the City during this renewal period will examine the possibility of moving to
VoIP (voice over internet) technology; and
WHEREAS, the Administration has reviewed the market conditions and recommends
renewal as being in the best interest of the City; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby authorizes and directs the
City Manager to send notice to GTE Southwest Incorporated d/b /a Verizon Southwest to renew the
CentraNet Telephone Services Agreement, as amended, for a one -year period pursuant to the terms
thereof.
Section 2: That the City Council of the City of Baytown authorizes payment to GTE
Southwest Incorporated d/b /a Verizon Southwest for the continuation of CentraNet Services of the
sum of SIXTY -TWO THOUSAND AND NO /100 DOLLARS ($62,000.00), pursuant to the
Agreement as amended and renewed.
Section 3: That pursuant to the provisions of Texas Local Government Code Annotated
§252.048, the City Manager is hereby granted general authority to approve any change order
involving a decrease or an increase in costs of TWENTY -FNE THOUSAND AND NO /100
DOLLARS ($25,000.00) or less, subject to the provision that the original contract price may not be
increased by more than twenty -five percent (25 %) or decreased by more than twenty -five percent
(25 %) without the consent of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
