Ordinance No. 9,623ORDINANCE NO. 9624 • AN; ORDINANCE OF THE CITY COUNCIL, CITY OF BAYTOWN, TEXAS, AUTHORIZING THE PAYMENT OF THIRTY -FOUR THOUSAND SEVEN HUNDRED SEVENTY -FIVE AND 16/100 DOLLARS ($34,775.16) TO INSIGHT, INC., FOR THE PURCHASE OF MICROSOFT CONTENT MANAGEMENT SERVER SOFTWARE; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City of Baytown is a member of the cooperative purchasing program established under Sections 271.082 and 271.083 of the Texas Local Government Code; and WHEREAS, the Qualified Information Services Vendor Catalogue Purchasing Program is such a program, allowing municipalities to purchase automated information systems products and/or services in a efficient, cost effective, and competitive procurement method; and WHEREAS, the City of Baytown in making a purchase under a state contract through such cooperative purchasing program satisfies state law requiring municipalities to seek competitive bids for the purchase of the item; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby authorizes the payment of THIRTY -FOUR THOUSAND SEVEN HUNDRED SEVENTY -FIVE AND 16/100 DOLLARS ($34,775.16) to Insight, Inc., for the purchase of Microsoft Content Management Server Software. Section 2: That the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs ofTWENTY -FIVE THOUSAND AND NO 1100 DOLLARS ($25,000.00) or less, provided that the original contract price may not be increased by more than twenty-five percent (25 %) or decreased by more than twenty-five percent (25 %) without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. WHEREAS, the City Council of the City of Baytown did authorize the Purchasing Department for the City of Baytown to advertise for bids for the Annual Installation and Repair of Traffic Signal Equipment Contract to be received August 19, 2003; and WHEREAS, notice to bidders as to the time and place, when and where the contract would be let was published pursuant to the provisions of Chapter 252 of the Texas Local Government Code; and WHEREAS, all bids were opened and publicly read at City Hall at 2:00 p.m., Tuesday, August 19, 2003, as per published notice to bidders; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section l: That the City Council of the City of Baytown hereby accepts the bid of Southwest Signal Supply, Inc., for the Annual Installation and Repair of Traffic Signal Equipment Contract for the sum of ONE HUNDRED FOURTEEN THOUSAND SEVEN HUNDRED AND N01100 DOLLARS ($114,700.00) and authorizes payment thereof. Section 2: That pursuant to the provisions of Texas Local Government Code Annotated § 252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of TWENTY -FIVE THOUSAND AND NO 1100 DOLLARS ($25,000.00) or less, subject to the provision that the original contract price may not be increased by more than twenty -five percent (25 %) or decreased by more than twenty -five percent (25 %) without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. •
