AUTHORIZING AND DIRECTING THE CITY MANAGER OF THE CITY OF
BAYTOWN TO EXECUTE THE NOTIFICATION OF AMENDMENT TO THE
PROFESSIONAL SERVICES AGREEMENT WITH BRJCKER + CANNADY
ARCHITECTS FOR THE BAYTOWN COMMUNITY CENTER RENOVATION
PROJECT; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN IN THE
AMOUNT OF TWENTY -SIX THOUSAND AND NO 1100 DOLLARS ($26,000.00);
MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes and directs the
City Manager of the City of Baytown to execute the Notification of Amendment to the Professional Services
Agreement with Bricker + Cannady Architects for the Baytown Community Center Renovation Project. A
copy of said contract is attached hereto, marked Exhibit "A," and made a part hereof for all intents and
purposes.
Section 2: That the City Council of the City of Baytown authorizes payment to Bricker +
Cannady Architects for the Baytown Community Center Renovation Project in the amount of TWENTY -SIX
THOUSAND AND NO 1100 DOLLARS ($26,000.00), pursuant to the contract.
Section 3: That the City Manager is hereby granted general authority to approve any change
order involving a decrease or an increase in costs of TWENTY -FIVE THOUSAND AND NO /100 DOLLARS
($25,000.00) or less, subject to the provision that the original contract price may not be increased by more than
twenty-five percent (25 %) or decreased by more than twenty-five percent (25 %) without the consent of the
contractor to such decrease.
Section 4: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.

Exhibit A
At the request of the Owner, the Architect has performed services beyond the original project
scope. These services included investigation of alternative materials and systems as related to
findings of the City's ACM consultant, and expanded detailed conceptual cost estimates for
additional proposed construction. Furthermore, additional Architectural and Engineering
services are required for design, construction documentation, bidding and construction
administration services related to the replacement of ceilings and light fixtures. The project
duration of the Owner/ Architect agreement is to be extended by seven months to July 17, 2004.
